Des indemnit\u00e9s lui sont alors vers\u00e9es, les sommes \u00e9tant per\u00e7ues 3 jours apr\u00e8s son mariage. Quelques ann\u00e9es plus tard, le couple divorce. Lors du partage du patrimoine, l\u2019ex-mari r\u00e9clame la moiti\u00e9 des\u00a0indemnit\u00e9s de\u00a0licenciement. Ce que refuse son ex-femme\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>\u2026 \u00e0 tort selon son ex-mari : \u00e0 compter du jour du mariage, toutes les sommes per\u00e7ues entrent dans le patrimoine commun, \u00e0 l\u2019exception des sommes pr\u00e9existantes au mariage ou obtenues par succession ou lib\u00e9ralit\u00e9s. D\u00e8s lors, les indemnit\u00e9s de licenciement\u00a0de son ex-femme,\u00a0per\u00e7ues 3 jours apr\u00e8s leur mariage, sont dans le patrimoine commun. Il a donc droit \u00e0 la moiti\u00e9 des indemnit\u00e9s.<\/p>\n<h3>Le verdict<\/h3>\n<p>\u00ab Faux \u00bb lui r\u00e9pond son ex-femme : les indemnit\u00e9s de licenciement sont dues \u00e0 compter de la notification de la rupture du contrat de travail. Or, cette notification a ici eu lieu 10 jours avant le mariage. Les indemnit\u00e9s doivent donc \u00eatre incluses dans son patrimoine personnel.
