Une personne est contact\u00e9e par une \u00e9tude g\u00e9n\u00e9alogique qui lui propose de conclure un contrat de r\u00e9v\u00e9lation pour l\u2019informer de l\u2019identit\u00e9 d\u2019une personne\u00a0d\u00e9c\u00e9d\u00e9e qui la d\u00e9signe comme h\u00e9riti\u00e8re. En \u00e9change, 30 % du patrimoine de la d\u00e9funte reviennent \u00e0 l\u2019\u00e9tude g\u00e9n\u00e9alogique. L\u2019h\u00e9riti\u00e8re refuse, mais l\u2019\u00e9tude\u00a0g\u00e9n\u00e9alogique apprend, peu apr\u00e8s, que l\u2019h\u00e9riti\u00e8re est directement all\u00e9e voir le notaire charg\u00e9 de la succession\u2026<\/p>\n

L’objet du litige<\/h3>\n

M\u00e9contente, l\u2019\u00e9tude g\u00e9n\u00e9alogique r\u00e9clame alors 30 % de sa part d\u2019h\u00e9ritage, estimant que c\u2019est gr\u00e2ce \u00e0 elle que l\u2019h\u00e9riti\u00e8re a eu connaissance de sa vocation\u00a0successorale. Ce que refuse l\u2019h\u00e9riti\u00e8re : elle pr\u00e9tend avoir appris le b\u00e9n\u00e9fice de cette succession gr\u00e2ce \u00e0 une connaissance et non par le courrier de l\u2019\u00e9tude\u00a0g\u00e9n\u00e9alogique qui ne mentionne d\u2019ailleurs ni l\u2019identit\u00e9 de la d\u00e9funte, ni celle du notaire.<\/p>\n

Le verdict<\/h3>\n

Ce que confirme le juge : la lettre envoy\u00e9e n\u2019ayant pas \u00e9t\u00e9 utile \u00e0 l\u2019h\u00e9riti\u00e8re pour conna\u00eetre ses droits, l\u2019\u00e9tude g\u00e9n\u00e9alogique n\u2019a donc pas droit \u00e0 30 % de la\u00a0part d\u2019h\u00e9ritage.<\/p>\n
