A cette occasion, l\u2019ex-\u00e9pouse demande \u00e0 son ex-mari de bien vouloir accepter qu\u2019elle conserve l\u2019usage de\u00a0son nom\u00a0de famille. Demande que rejette ce dernier, estimant qu\u2019elle ne doit plus utiliser son nom de famille\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>\u2026 \u00e0 tort selon son ex-\u00e9pouse : elle rappelle qu\u2019un conjoint peut conserver l\u2019usage du nom de l\u2019autre s\u2019il justifie d\u2019un int\u00e9r\u00eat particulier. Ce\u00a0qui\u00a0est son cas, estime-t-elle en raison de la dur\u00e9e de leur mariage (22 ans), de leurs enfants qui sont encore mineurs et de son activit\u00e9\u00a0professionnelle puisqu\u2019elle a toujours travaill\u00e9 sous le nom de son ex-mari.<\/p>\n<h3>Le verdict<\/h3>\n<p>El\u00e9ments insuffisants pour son ex-mari : vis-\u00e0-vis de leurs enfants mineurs, le fait qu\u2019elle conserve son nom n\u2019apporte aucun b\u00e9n\u00e9fice et\u00a0au niveau\u00a0professionnel, \u00e9tant secr\u00e9taire dans une entreprise, la perte de son nom marital n\u2019affecte en rien son m\u00e9tier. D\u00e8s lors, il\u00a0consid\u00e8re que son ex-\u00e9pouse ne justifie pas d\u2019un int\u00e9r\u00eat particulier \u00e0 la conservation de son nom.
