L\u2019atelier-garage empi\u00e8te, en effet, sur son terrain. Il demande donc \u00e0 ce que l\u2019ouvrage soit totalement d\u00e9moli.<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p style=\"font-weight: 400;\">Pour le propri\u00e9taire, l&#8217;empi\u00e9tement de la construction sur son terrain est un viol de son droit de propri\u00e9t\u00e9. Comme la Loi le lui permet, il demande donc la d\u00e9molition totale de l\u2019atelier-garage aux frais de son voisin. D\u00e9molition que conteste ce dernier. Pour lui, cette solution est totalement disproportionn\u00e9e, l\u2019empi\u00e9tement n\u2019\u00e9tant que de 0,04m\u00b2. Il estime qu\u2019un simple rabotage du mur de l\u2019atelier-garage est plus appropri\u00e9, cette solution permettant \u00e9galement de mettre fin \u00e0 l\u2019empi\u00e9tement \u00e0 moindre co\u00fbt.<\/p>\n<h3>Le verdict<\/h3>\n<p style=\"font-weight: 400;\">A raison pour le juge\u00a0! Il rappelle que dans une situation d\u2019empi\u00e9tement, il faut rechercher s\u2019il n\u2019existe pas une solution alternative \u00e0 la d\u00e9molition totale. Ce qui est le cas dans cette affaire.
