Un couple d\u00e9cide de construire un nouveau b\u00e2timent sur le terrain de camping qu\u2019il exploite. Leur voisine, estimant que la nouvelle construction entra\u00eene une perte de l\u2019ensoleillement sur son terrain, lui r\u00e9clame un d\u00e9dommagement. Ce qu\u2019il refuse\u2026<\/p>\n

L’objet du litige<\/h3>\n

Concr\u00e8tement, la voisine estime que le couple a implant\u00e9 le nouveau b\u00e2timent trop pr\u00e8s de sa maison, en violation des r\u00e8gles d\u2019urbanisme, provoquant ainsi une perte d\u2019ensoleillement (v\u00e9rifi\u00e9e par un expert-judiciaire). En outre, il existe d\u00e9sormais des risques d\u2019\u00e9boulements sur son terrain. Pour elle, il s\u2019agit l\u00e0 d\u2019un trouble du voisinage qui doit \u00eatre indemnis\u00e9 par le couple\u2026<\/p>\n

Le verdict<\/h3>\n

\u2026 \u00e0 tort pour le juge\u00a0! Parce que la construction respecte les r\u00e8gles d\u2019urbanisme, parce que la perte d\u2019ensoleillement n\u2019est que partielle (en hiver, au soleil couchant), parce que les terrains se trouvent dans une zone urbanis\u00e9e et parce qu\u2019il n\u2019y a eu aucun \u00e9boulement, le trouble de voisinage n\u2019est pas prouv\u00e9. La demande d\u2019indemnisation de la voisine est donc rejet\u00e9e.<\/p>\n
