Refus de son ex-mari, qui consid\u00e8re que le patrimoine de son ex-femme est suffisant. Cette derni\u00e8re saisit alors le juge\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p style=\"font-weight: 400;\">Pour elle, la prestation est destin\u00e9e \u00e0 compenser, autant qu\u2019il est possible, la disparit\u00e9 que la rupture du mariage cr\u00e9e dans les conditions de vie respectives. Disparit\u00e9 ici illustr\u00e9e par le fait qu\u2019elle ne peut plus mener le m\u00eame train de vie.<\/p>\n<h3>Le verdict<\/h3>\n<p style=\"font-weight: 400;\">Mais son ex-mari rappelle que la prestation compensatoire n\u2019est pas automatique et qu\u2019elle n\u2019a pas pour finalit\u00e9 d\u2019arriver \u00e0 une stricte \u00e9galit\u00e9 des fortunes, m\u00eame s\u2019il est ind\u00e9niable que son ex-\u00e9pouse ne pourra plus mener un train de vie dispendieux. En outre, son ex-femme a profit\u00e9 de leur mariage et de sa position sociale pour augmenter son patrimoine (qui n\u2019est pas n\u00e9gligeable). Pour lui, la prestation compensatoire n\u2019est pas due.
