Mais l\u2019avocat de la soci\u00e9t\u00e9, qui entre-temps a \u00e9t\u00e9 nomm\u00e9 magistrat mais n\u2019est pas encore entr\u00e9 en fonction, d\u00e9cide de faire appel. Recours irrecevable puisque l\u2019appel est irr\u00e9gulier, estime le client. Il consid\u00e8re, en effet, que l\u2019avocat n\u2019exer\u00e7ait plus en cette qualit\u00e9 au moment o\u00f9 l\u2019appel a \u00e9t\u00e9 effectu\u00e9.<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p style=\"font-weight: 400;\">Le client rappelle que quelques semaines avant de faire appel, l\u2019avocat de la partie adverse a \u00e9t\u00e9 nomm\u00e9 magistrat par D\u00e9cret pr\u00e9sidentiel. Or, la profession d\u2019avocat est incompatible avec l\u2019exercice de toute autre profession. Ne pouvant cumuler 2 professions, le client consid\u00e8re que, l\u2019avocat \u00e9tant devenu magistrat, l\u2019appel est irr\u00e9gulier et irrecevable.<\/p>\n<h3>Le verdict<\/h3>\n<p style=\"font-weight: 400;\">Ce que conteste l\u2019avocat&nbsp;: devenir magistrat suppose de pr\u00eater&nbsp;&nbsp;, formalit\u00e9 qu\u2019il n\u2019avait pas encore accomplie lorsqu\u2019il a fait appel. Il consid\u00e8re donc qu\u2019il \u00e9tait encore avocat \u00e0 ce moment-l\u00e0\u2026 \u00e0 raison pour le juge&nbsp;!
