Mais n\u2019\u00e9tant pas pay\u00e9 pour les honoraires dus, l\u2019architecte met en demeure son client de le payer, puis, faute de paiement, il engage une action justice 5 ans plus tard. Action irrecevable selon le particulier\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p style=\"font-weight: 400;\">Ce dernier consid\u00e8re, en effet, que l\u2019action en justice est tardive car l\u2019architecte avait 2 ans pour agir, puisqu\u2019il b\u00e9n\u00e9ficie du statut protecteur du \u00ab\u00a0consommateur\u00a0\u00bb. L\u2019action ayant \u00e9t\u00e9 ici engag\u00e9e 5 ans apr\u00e8s la mise en demeure, elle est irrecevable. Retard que l\u2019architecte explique par un cas de \u00ab\u00a0force majeure\u00a0\u00bb qui a interrompu le d\u00e9lai de prescription. Il a \u00e9t\u00e9 longuement hospitalis\u00e9, et ce \u00e0 plusieurs reprises \u00e0 cause de graves probl\u00e8mes de sant\u00e9.<\/p>\n<h3>Le verdict<\/h3>\n<p style=\"font-weight: 400;\">Action\u2026 prescrite pour le juge\u00a0: l\u2019hospitalisation de l\u2019architecte n\u2019\u00e9tait pas de nature \u00e0 caract\u00e9riser un cas de \u00ab\u00a0force majeure\u00a0\u00bb l\u2019emp\u00eachant d\u2019agir en justice.
