Elagage que refuse de r\u00e9aliser le propri\u00e9taire\u2026<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p style=\"font-weight: 400;\">Pour justifier son refus, le propri\u00e9taire explique, rapport d\u2019expert \u00e0 l\u2019appui, que la conservation des branches qui d\u00e9passent sur la rue est n\u00e9cessaire car elle am\u00e9liore l\u2019\u00e9quilibre de l\u2019arbre. Si on coupe toutes les branches qui d\u00e9passent, le platane serait, en effet, totalement d\u00e9s\u00e9quilibr\u00e9. Cette situation causerait un p\u00e9ril encore plus important que le risque d\u2019ins\u00e9curit\u00e9 all\u00e9gu\u00e9 par la Mairie.<\/p>\n<h3>Le verdict<\/h3>\n<p style=\"font-weight: 400;\">Mais c\u2019est peine perdue pour le propri\u00e9taire. Le juge rappelle que la Mairie, en tant que propri\u00e9taire de la rue sur laquelle s\u2019\u00e9tendent les branches du platane, dispose d\u2019un droit imprescriptible de contraindre ce dernier \u00e0 les couper.
