C\u2019est l\u2019histoire d\u2019une \u00e9pouse qui conteste le caract\u00e8re joint d\u2019un compte bancaire\u2026<\/i><\/b><\/h2>\n

Le compte bancaire utilis\u00e9 par un couple pr\u00e9sentant un solde d\u00e9biteur, une banque r\u00e9clame le remboursement du\u00a0d\u00e9couvert \u00e0 l\u2019\u00e9poux et\u00a0\u00e0 l\u2019\u00e9pouse. Mais cette derni\u00e8re ne s\u2019estime pas concern\u00e9e, le compte ne lui appartenant pas\u2026<\/p>\n

L’objet du litige<\/h3>\n

\u2026 ce que conteste la banque : les relev\u00e9s bancaires sont \u00e9tablis au nom du couple, appellation r\u00e9v\u00e9latrice d\u2019un compte\u00a0joint. L\u2019\u00e9pouse\u00a0est donc cotitulaire du compte et l\u2019action engag\u00e9e contre elle est valable. \u00ab Faux \u00bb r\u00e9pond l\u2019\u00e9pouse qui\u00a0rappelle que son mari a ouvert\u00a0seul le compte. Elle n\u2019a sign\u00e9 aucun contrat de compte joint avec la banque et n\u2019est donc\u00a0pas cotitulaire du compte. Ce qui rend l\u2019action\u00a0de la banque irrecevable\u2026<\/p>\n

Le verdict<\/h3>\n

\u2026 \u00e0 raison pour le juge ! M\u00eame si un compte est libell\u00e9 au nom d\u2019un couple, il ne constitue pas un compte joint d\u00e8s lors\u00a0qu\u2019il a \u00e9t\u00e9 ouvert\u00a0par un seul des 2 \u00e9poux. Par cons\u00e9quent, l\u2019\u00e9pouse n\u2019est pas cotitulaire du compte pr\u00e9sentant un solde\u00a0d\u00e9biteur et l\u2019action engag\u00e9e \u00e0 son\u00a0encontre est irrecevable !<\/p>\n

\u2026 ce que conteste la banque \u00e0 la lecture des relev\u00e9s de comptes \u00e9tablis au nom du couple\u2026<\/p>\n
