Or, son voisin d\u00e9cide un\u00a0jour d\u2019annexer les terrasses communes pour son compte personnel. La copropri\u00e9taire lui demande alors de lib\u00e9rer les terrasses communes.\u00a0Devant le refus de son voisin, elle d\u00e9cide d\u2019engager une action en justice.<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>Action que son voisin consid\u00e8re irrecevable ! Il rappelle que si un copropri\u00e9taire peut agir seul en justice, c\u2019est uniquement pour les litiges\u00a0relatifs \u00e0 la propri\u00e9t\u00e9 ou \u00e0 la jouissance de son lot de copropri\u00e9t\u00e9. Or, le litige porte ici sur des terrasses qui sont communes \u00e0 la\u00a0copropri\u00e9t\u00e9. Par cons\u00e9quent, la copropri\u00e9taire n\u2019est pas habilit\u00e9e \u00e0 saisir la justice : seul le syndicat des copropri\u00e9taires peut le faire.<\/p>\n<h3>Le verdict<\/h3>\n<p>\u00ab Faux \u00bb r\u00e9pond le juge qui rappelle qu\u2019un copropri\u00e9taire peut tout \u00e0 fait demander la cessation d\u2019une atteinte port\u00e9e aux parties\u00a0communes.
