Mais en raison de son\u00a0absence\u00a0prolong\u00e9e, elle est licenci\u00e9e : selon son employeur, son remplacement d\u00e9finitif est n\u00e9cessaire.<\/p>\n<h3>L&rsquo;objet du litige<\/h3>\n<p>Licenciement que la salari\u00e9e conteste : elle rappelle qu\u2019un employeur doit justifier de la n\u00e9cessit\u00e9 de pourvoir \u00e0 un remplacement\u00a0d\u00e9finitif, ce\u00a0que ne peut pas faire son employeur. Ce dernier n\u2019a, en effet, pas organis\u00e9 de visite de reprise destin\u00e9e \u00e0 appr\u00e9cier son\u00a0aptitude au travail et par\u00a0cons\u00e9quent, la n\u00e9cessit\u00e9 ou non de remplacement d\u00e9finitif.<\/p>\n<h3>Le verdict<\/h3>\n<p>A tort pour le juge : il rel\u00e8ve, d\u2019une part, que la salari\u00e9e n\u2019a pas repris le travail suite \u00e0 l\u2019expiration de son arr\u00eat de travail et d\u2019autre part,\u00a0qu\u2019elle a manifest\u00e9, d\u00e8s le mois de juin, l\u2019intention de ne plus venir travailler au domicile de son employeur.
