Une personne d\u00e9c\u00e8de en laissant pour seul h\u00e9ritier son fr\u00e8re. Sauf qu\u2019une amie du d\u00e9funt produit un testament \u00ab olographe \u00bb, r\u00e9dig\u00e9 2 semaines\u00a0avant sa mort, la d\u00e9signant comme l\u00e9gataire universelle de tout le patrimoine de son ami. Les circonstances de la r\u00e9daction du testament sont\u00a0toutefois suspicieuses, selon le fr\u00e8re, qui conteste la validit\u00e9 du testament\u2026<\/p>\n

L’objet du litige<\/h3>\n

\u2026 \u00e0 tort selon la l\u00e9gataire : le testament, r\u00e9dig\u00e9 de sa main, l\u2019a \u00e9t\u00e9 sous la dict\u00e9e du d\u00e9funt qui l\u2019a sign\u00e9, en pr\u00e9sence de 2 t\u00e9moins qui l\u2019ont\u00a0sign\u00e9. En outre, elle produit divers t\u00e9moignages attestant que son ami voulait lui faire un legs. Testament nul estime toutefois le fr\u00e8re du d\u00e9funt :\u00a0pour lui, le testament doit obligatoirement \u00eatre r\u00e9dig\u00e9 de la main du testateur. Son fr\u00e8re n\u2019ayant pas ici r\u00e9dig\u00e9 son testament, ce document est\u00a0donc nul\u2026<\/p>\n

Le verdict<\/h3>\n

\u2026 \u00e0 raison pour le juge ! Un testament \u00ab olographe \u00bb n\u2019est pas valable s\u2019il n\u2019est pas \u00e9crit en entier de la main du testateur. D\u00e8s lors, le testament\u00a0dont se pr\u00e9vaut la l\u00e9gataire est nul.<\/p>\n
