Cette derni\u00e8re ayant re\u00e7u une amende pour usage du t\u00e9l\u00e9phone au volant, elle d\u00e9signe aux autorit\u00e9s l\u2019entrepreneur comme conducteur de la voiture\u2026<\/p>\n\n\n\n<p>D\u00e9sign\u00e9 responsable de l\u2019infraction, l\u2019entrepreneur conteste&nbsp;: l\u2019infraction a \u00e9t\u00e9 constat\u00e9e \u00e0 distance via un radar automatique&nbsp;; puisque l\u2019identit\u00e9 du conducteur n\u2019a pas \u00e9t\u00e9 contr\u00f4l\u00e9e, rien ne prouve que c\u2019est lui qui \u00e9tait au volant \u00e0 ce moment pr\u00e9cis\u2026 Sauf que le contrat de location stipule que le locataire est le seul \u00e0 pouvoir conduire la voiture, sauf accord expr\u00e8s du loueur, ce qui n\u2019\u00e9tait pas le cas ici, rappelle la soci\u00e9t\u00e9 de location\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p><br>Ce qui suffit \u00e0 le consid\u00e9rer responsable de l\u2019infraction, confirme le juge\u00a0: il est contractuellement le seul \u00e0 \u00eatre autoris\u00e9 \u00e0 conduire le v\u00e9hicule, il l\u2019utilise pour son activit\u00e9 professionnelle et il n\u2019apporte aucune preuve qu\u2019il n\u2019\u00e9tait effectivement pas au volant au moment des faits\u2026<\/p>\n\n\n\n<p><a
