Les honoraires pr\u00e9vus sont de 50 % des indemnit\u00e9s re\u00e7ues et exc\u00e9dant le co\u00fbt des travaux\u2026<\/p>\n\n\n\n<p>Mais l\u2019entreprise r\u00e9silie la convention par anticipation\u2026 S\u2019estimant victime d\u2019un pr\u00e9judice, le prestataire lui r\u00e9clame, \u00e0 titre de dommages-int\u00e9r\u00eats, ses honoraires qu\u2019il aurait per\u00e7us si la convention \u00e9tait arriv\u00e9e \u00e0 son terme puisque, les d\u00e9sordres n\u2019\u00e9tant pas contest\u00e9s, il n\u2019y a aucune incertitude sur le fait que l\u2019entreprise obtiendra des indemnit\u00e9s. Mais l\u2019entreprise refuse&nbsp;: son pr\u00e9judice n\u2019est qu\u2019une perte de chance de percevoir des honoraires, dont le montant \u00e9tait incertain lors de la rupture du contrat. Il ne peut donc pas pr\u00e9tendre \u00e0 l\u2019int\u00e9gralit\u00e9 de ses honoraires\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Ce que confirme le juge\u00a0: le pr\u00e9judice s\u2019analyse ici en une perte de chance, de sorte que l\u2019indemnisation ne peut pas \u00eatre \u00e9gale \u00e0 l\u2019int\u00e9gralit\u00e9 des honoraires pr\u00e9vus.<\/p>\n\n\n\n<p><a
