Parce qu\u2019il s\u2019agissait de sa r\u00e9sidence principale, il a appliqu\u00e9 l\u2019exon\u00e9ration fiscale au gain r\u00e9alis\u00e9 \u00e0 l\u2019occasion de la vente de cette maison\u2026<\/p>\n\n\n\n<p>Sauf que cette maison n\u2019a \u00e9t\u00e9 occup\u00e9e par le vendeur que quelques mois, rel\u00e8ve l\u2019administration fiscale qui lui refuse alors le b\u00e9n\u00e9fice de cette exon\u00e9ration d\u2019imp\u00f4t : pour elle, le propri\u00e9taire n\u2019a, en r\u00e9alit\u00e9, jamais eu l\u2019intention de faire de cette maison sa r\u00e9sidence principale. Partant de l\u00e0, l\u2019exon\u00e9ration ne peut que lui \u00eatre refus\u00e9e, selon l\u2019administration\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Sauf que la circonstance que le propri\u00e9taire n\u2019a pas eu l\u2019intention de faire de cette maison sa r\u00e9sidence principale est \u00e0 elle seule insuffisante, estime le juge : faute pour l\u2019administration de ne pas avoir recherch\u00e9 si les conditions d\u2019occupation de la maison permettaient ou non de la qualifier de \u00ab r\u00e9sidence principale \u00bb, l\u2019exon\u00e9ration ne peut pas \u00eatre refus\u00e9e\u2026<br><a
