{"id":24158,"date":"2025-04-25T08:15:00","date_gmt":"2025-04-25T06:15:00","guid":{"rendered":"https:\/\/avoloi.fr\/blog\/?p=24158"},"modified":"2025-04-24T12:11:57","modified_gmt":"2025-04-24T10:11:57","slug":"larret-du-jour-405-le-renouvellement-du-bail-commercial","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/larret-du-jour-405-le-renouvellement-du-bail-commercial\/","title":{"rendered":"L&rsquo;arr\u00eat du jour #405: Le renouvellement du bail commercial"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\" id=\"c-est-l-histoire-d-un-conducteur-a-l-origine-ou-victime-d-un-accident-de-la-route\">C\u2019est l\u2019histoire d\u2019un bailleur qui augmente le loyer commercial de son locataire\u2026<\/h3>\n\n\n\n<p>Alors que son bail commercial arrive \u00e0 son terme, une commer\u00e7ante en demande le renouvellement aupr\u00e8s de son bailleur, lequel accepte le principe, tout en faisant toutefois une proposition de r\u00e9\u00e9valuation \u00e0 la hausse du loyer\u2026<\/p>\n\n\n\n<p>\u2026 qui s\u2019av\u00e8re trop \u00e9lev\u00e9e pour la locataire, qui rappelle que des r\u00e8gles de plafonnement limitent les hausses trop importantes des loyers commerciaux. Sauf exception, rappelle \u00e0 son tour le bailleur, dont une pour le cas o\u00f9, en cours de contrat, une loi lui impose une nouvelle obligation financi\u00e8re. Ce qui est le cas ici, la loi imposant d\u00e9sormais au bailleur de souscrire une assurance propri\u00e9taire non occupant\u2026 Ce qui ne repr\u00e9sente pas une charge nouvelle, conteste le locataire, le bailleur ayant souscrit cette assurance volontairement au pr\u00e9alable\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Ce qui ne change rien pour le juge, lequel rel\u00e8ve que c\u2019est bien l\u2019aspect nouveau de l\u2019obligation l\u00e9gale qui importe\u2026 et confirme que le loyer du bail renouvel\u00e9 peut ici \u00eatre fix\u00e9 selon les r\u00e8gles du d\u00e9plafonnement !<a
