Le couple, inform\u00e9 des conditions de la vente, d\u00e9cide d\u2019exercer son droit de pr\u00e9f\u00e9rence. Mais la propri\u00e9taire refuse de lui vendre la maison\u2026<\/p>\n\n\n\n<p>Le couple engage une proc\u00e9dure pour obtenir l\u2019application du pacte, mais la propri\u00e9taire d\u00e9c\u00e8de entre temps, laissant pour l\u00e9gataire universel\u2026 le tiers qui s\u2019est port\u00e9 acqu\u00e9reur de la maison, qui conteste l\u2019application du pacte de pr\u00e9f\u00e9rence : parce qu\u2019il ne contient aucune dur\u00e9e de validit\u00e9, cela revient \u00e0 en faire, selon lui, un engagement perp\u00e9tuel, interdit par la loi. Ce pacte n\u2019a donc aucune valeur pour lui\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Sauf qu\u2019un engagement perp\u00e9tuel n\u2019est pas sanctionn\u00e9 par la nullit\u00e9 du contrat, mais chaque contractant peut y mettre fin \u00e0 tout moment, en respectant un d\u00e9lai de pr\u00e9avis, rappelle le juge : en l&rsquo;absence,ici, de r\u00e9siliation du pacte, le couple peut donc exercer son droit de pr\u00e9f\u00e9rence\u2026<a
