En cause\u00a0: la valeur du bien hypoth\u00e9qu\u00e9 qui a \u00e9t\u00e9 tr\u00e8s largement surestim\u00e9e\u2026<\/p>\n\n\n\n<p class=\"wp-block-paragraph\">Pour que ces pr\u00eats soient valables, encore faut-il que leur p\u00e8re y ait consenti en toute connaissance de cause, selon les h\u00e9ritiers\u00a0: surestimer la valeur de la maison, objet de l\u2019hypoth\u00e8se, est une erreur \u00ab\u00a0d\u00e9terminante\u00a0\u00bb, selon eux, de nature \u00e0 vicier le consentement de leur p\u00e8re \u00e0 ces pr\u00eats\u2026 Sauf que, pour la banque, la sur\u00e9valuation du bien immobilier affect\u00e9 par l&rsquo;hypoth\u00e8que ne constitue pas une erreur d\u00e9terminante du consentement pour la signature du pr\u00eat\u00a0: le seul \u00e9l\u00e9ment d\u00e9terminant du consentement de l&#8217;emprunteur est d&rsquo;obtenir le montant du pr\u00eat souhait\u00e9, ce qu\u2019il a obtenu ici\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p class=\"wp-block-paragraph\">Sauf que l&rsquo;\u00e9valuation \u00e0 dire d&rsquo;expert du bien hypoth\u00e9qu\u00e9 est n\u00e9cessairement d\u00e9terminante du consentement de l&#8217;emprunteur, rappelle le juge\u2026 qui donne raison aux h\u00e9ritiers\u00a0!<a
