Pour cela, le voisin monte sur le toit, mais chute et se blesse assez gravement. Il se retourne alors contre le propri\u00e9taire de l\u2019abri de jardin pour \u00eatre indemnis\u00e9\u2026<\/p>\n\n\n\n<p>Le voisin rappelle qu\u2019en cas d\u2019assistance b\u00e9n\u00e9vole, la personne aid\u00e9e doit r\u00e9parer les dommages corporels caus\u00e9s \u00e0 la personne qui a apport\u00e9 son aide. Mais le propri\u00e9taire fait remarquer que son voisin \u00e9tait d\u00e9j\u00e0 bless\u00e9 au doigt avant de l\u2019aider\u00a0: en montant sur le toit de l\u2019abri de jardin, il a lui-m\u00eame commis une faute, sa blessure au doigt l\u2019emp\u00eachant d\u2019\u00eatre bien stable. \u00ab\u00a0Une simple imprudence\u00a0!\u00a0\u00bb, se d\u00e9fend le voisin, selon qui seule une faute lourde permettrait d\u2019exon\u00e9rer le propri\u00e9taire de l\u2019abri de jardin\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>\u00ab\u00a0Faux\u00a0!\u00a0\u00bb, tranche le juge en faveur du propri\u00e9taire\u00a0: dans une convention d\u2019assistance b\u00e9n\u00e9vole, n\u2019importe quelle faute de l\u2019assistant d\u00e9charge en tout ou partie la personne aid\u00e9e de sa responsabilit\u00e9, m\u00eame la faute d\u2019imprudence\u00a0!<a
