Ne recevant pas le plaid en question, elle d\u00e9cide de d\u00e9poser plainte pour abus de confiance et obtient la condamnation du vendeur\u2026<\/p>\n\n\n\n<p>\u2026qui conteste tout abus de confiance ici. Pourtant, il a bien re\u00e7u et encaiss\u00e9 le ch\u00e8que de 450 \u20ac, rappelle la vendeuse ; de plus, il n\u2019a pas \u00e9t\u00e9 en mesure de prouver non seulement l\u2019envoi du plaid, mais aussi le fait qu\u2019il n\u2019a jamais \u00e9t\u00e9 r\u00e9ellement d\u00e9tenteur d\u2019un tel objet. Pour autant, se d\u00e9fend le vendeur, cela ne permet pas d\u2019\u00e9tablir un \u00ab\u00a0abus de confiance\u00a0\u00bb, ces termes supposant que la somme aurait d\u00fb \u00eatre restitu\u00e9e ou r\u00e9utilis\u00e9e dans un but pr\u00e9cis. Ce qui, selon lui, n\u2019est pas compatible avec le contrat r\u00e9sultant de la vente d\u2019un objet\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Ce que confirme le juge\u00a0: l\u2019abus de confiance suppose la remise d\u2019une somme d\u2019argent ou d\u2019un bien \u00e0 titre \u00ab\u00a0pr\u00e9caire\u00a0\u00bb, ce qui n\u2019est pas le cas lors d\u2019une vente. La condamnation du vendeur n\u2019est pas adapt\u00e9e\u2026<a
