Au d\u00e9c\u00e8s de la s\u0153ur, son fils r\u00e9clame une indemnit\u00e9 \u00e0 son oncle pour l\u2019occupation privative de l\u2019appartement. Ce que ce dernier refuse\u2026<\/p>\n\n\n\n<p>Et pour cause\u00a0! Si effectivement, en tant qu\u2019un indivisaire qui occupe un bien indivis, il est normalement redevable d\u2019une indemnit\u00e9, une exception doit ici jouer en sa faveur, estime-t-il\u00a0: en l\u2019occurrence, l\u2019\u00e9tat de l\u2019appartement. Compl\u00e8tement v\u00e9tuste, il rappelle qu\u2019il n\u2019a aucune valeur locative, de sorte qu\u2019aucune indemnit\u00e9 n\u2019est due selon lui\u2026 Ce que conteste son neveu\u00a0: quand bien m\u00eame l\u2019appartement est v\u00e9tuste et sans valeur locative, il y a tout de m\u00eame une occupation privative d\u2019un bien indivis. Par cons\u00e9quent, une indemnit\u00e9 lui est donc due\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Ce que confirme le juge\u00a0: l\u2019obligation d&rsquo;indemniser son neveu en raison de la jouissance privative de l\u2019appartement ne peut \u00eatre exclue du fait de son \u00e9tat v\u00e9tuste. Il doit donc l\u2019indemniser\u00a0!<a
