Il se trouve que l\u2019un des h\u00e9ritiers exhume un testament olographe le d\u00e9signant comme l\u00e9gataire universel. Un testament que son fr\u00e8re, qui s\u2019estime injustement \u00e9vinc\u00e9 de la succession, va contester\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"l-objet-du-litige\">L\u2019objet du litige <\/h3>\n\n\n\n<p>Il se trouve que ce testament a \u00e9t\u00e9 r\u00e9dig\u00e9 au dos d\u2019un relev\u00e9 bancaire, sans \u00eatre dat\u00e9, condition pourtant essentielle de validit\u00e9 d\u2019un testament olographe, qui est donc nul estime le fr\u00e8re \u00e9vinc\u00e9\u2026 Un testament r\u00e9dig\u00e9 au dos d\u2019un relev\u00e9 bancaire qui mentionne la valorisation d\u2019une \u00e9pargne \u00e0 une date pr\u00e9cise, rappelle le fr\u00e8re h\u00e9ritier. Ce qui est donc suffisant pour dater le testament, puisqu\u2019il est admis qu\u2019en l\u2019absence de date, un testament olographe est valable si des indices \u00e9tablissent qu&rsquo;il a \u00e9t\u00e9 r\u00e9dig\u00e9 au cours d&rsquo;une p\u00e9riode d\u00e9termin\u00e9e\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Ce que reconna\u00eet le juge qui admet la validit\u00e9 du testament, apr\u00e8s s\u2019\u00eatre assur\u00e9 que le fr\u00e8re d\u00e9c\u00e9d\u00e9 n\u2019\u00e9tait pas, \u00e0 la date du relev\u00e9 bancaire, atteint d\u2019une incapacit\u00e9 quelconque \u00e0 le r\u00e9diger\u2026<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><a
