Comme la r\u00e8gle le pr\u00e9voit, il r\u00e9clame une indemnisation pour les dommages subis, mais l\u2019automobiliste refuse rappelant que cette r\u00e8gle ne s\u2019applique pas si le motard a commis une faute\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"l-objet-du-litige\">L\u2019objet du litige <\/h3>\n\n\n\n<p>Et c\u2019est le cas selon lui\u00a0: le motard roulait \u00e0 une vitesse excessive, comprise entre 110 et 132 km\/h, sur la route d\u00e9partementale sur laquelle a eu lieu l\u2019accident et n\u2019a m\u00eame pas ralenti apr\u00e8s l\u2019avoir aper\u00e7u sur l\u2019accotement \u00e0 200 m\u00e8tres devant lui. Clairement pour lui, la faute est ici caract\u00e9ris\u00e9e\u2026 Sauf qu\u2019il n\u2019est pas \u00e0 l\u2019origine de l\u2019accident, conteste le motard, qui d\u00e9cline toute responsabilit\u00e9 ici et maintient sa demande d\u2019indemnisation pour les dommages subis\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Mais ce n\u2019est pas l\u2019avis du juge, qui rejette la demande du motard\u00a0: s\u2019il n\u2019avait pas roul\u00e9 aussi vite et s\u2019il avait anticip\u00e9, la collision aurait pu \u00eatre \u00e9vit\u00e9e. Son comportement est donc ici fautif et a contribu\u00e9 \u00e0 son pr\u00e9judice\u00a0: il ne peut donc pas \u00eatre indemnis\u00e9\u00a0!<\/p>\n\n\n\n<blockquote class=\"wp-block-quote
