Cependant, pour l\u2019administration il se rend coupable d\u2019avoir \u00e9tabli un \u00ab\u00a0faux document administratif\u00a0\u00bbn\u2019\u00e9tant ni le p\u00e8re de l\u2019enfant, ni en couple avec la m\u00e8re\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"l-objet-du-litige\">L\u2019objet du litige <\/h3>\n\n\n\n<p>Insuffisant pour le d\u00e9clarer coupable selon lui. Il sait bien ne pas \u00eatre le p\u00e8re biologique de l\u2019enfant mais cela ne l\u2019emp\u00eache pas d\u2019avoir le d\u00e9sir de l\u2019\u00e9lever, chose qu\u2019il entend affirmer avec ce document. Mais selon l\u2019administration, si l\u2019homme et son \u00e9pouse se sont rapproch\u00e9s d\u2019une femme enceinte et se sont entendus avec elle avant la reconnaissance de paternit\u00e9, c\u2019\u00e9tait bien dans l\u2019optique de court-circuiter les proc\u00e9dures l\u00e9gales d\u2019adoption, ce qui constitue une fraude.<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>\u00ab\u00a0Peu importe\u00a0!\u00a0\u00bb pour le juge qui rappelle que, quelles que soient les intentions du signataire, une reconnaissance de paternit\u00e9 n\u2019est pas conditionn\u00e9e \u00e0 l\u2019existence d\u2019un lien biologique. Il n\u2019est pas possible de consid\u00e9rer qu\u2019il y ait eu ici un \u00ab\u00a0faux document administratif\u00a0\u00bb.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow
