Il est alors p\u00e9nalement poursuivi par le minist\u00e8re public pour faute d\u2019inattention. Mais pour \u00eatre sanctionn\u00e9, il faut ne pas avoir accompli de \u00ab\u00a0diligences normales\u00a0\u00bb, fait remarquer le plaisancier. Ce qui n\u2019est pas son cas\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"l-objet-du-litige\">L\u2019objet du litige <\/h3>\n\n\n\n<p>\u00ab\u00a0Faux\u00a0!\u00a0\u00bb, r\u00e9plique le minist\u00e8re public\u00a0: il est \u00e9tabli que le plaisancier avait rep\u00e9r\u00e9 la bou\u00e9e du plongeur peu de temps avant l\u2019accident. Sachant qu\u2019il avait le soleil dans les yeux et que l\u2019avant de son bateau \u00e9tait l\u00e9g\u00e8rement relev\u00e9, il aurait donc d\u00fb \u00eatre plus prudent dans sa navigation. Sauf qu\u2019il n\u2019existe aucune interdiction ou restriction r\u00e9glementaire de navigation autour d&rsquo;une bou\u00e9e flottant en mer, conteste le plaisancier, qui rappelle, en outre, qu\u2019il naviguait dans un chenal \u00e0 une petite vitesse \u00e9valu\u00e9e \u00e0 3 n\u0153uds. Il a donc accompli les \u00ab\u00a0diligences normales\u00a0\u00bb, selon lui\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Mais pas selon le juge, qui condamne le plaisancier\u00a0: il aurait d\u00fb naviguer avec plus de prudence\u00a0!<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow wp-block-quote-is-layout-flow\">\n<p><a
