{"id":23792,"date":"2023-07-14T08:20:00","date_gmt":"2023-07-14T06:20:00","guid":{"rendered":"https:\/\/avoloi.fr\/blog\/?p=23792"},"modified":"2023-07-13T17:14:36","modified_gmt":"2023-07-13T15:14:36","slug":"larret-du-jour-356-le-voilier-confisque","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/larret-du-jour-356-le-voilier-confisque\/","title":{"rendered":"L&rsquo;arr\u00eat du jour #356 : Le voilier confisqu\u00e9"},"content":{"rendered":"\n<h3 class=\"wp-block-heading\" id=\"c-est-l-histoire-d-un-conducteur-a-l-origine-ou-victime-d-un-accident-de-la-route\"><strong><em><strong><em>C\u2019est l\u2019histoire de plaisanciers qui ramassent de tr\u00e8s (tr\u00e8s) beaux coquillages\u2026<\/em><\/strong><\/em><\/strong><\/h3>\n\n\n\n<p>Parce qu\u2019il a mis en vente des lingots d\u2019or aux \u00c9tats-Unis qui se sont av\u00e9r\u00e9s provenir d\u2019un pillage d\u2019une \u00e9pave au large des c\u00f4tes fran\u00e7aises, un couple est poursuivi par la justice, qui confisque son bateau, sur lequel il habite\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"l-objet-du-litige\">L\u2019objet du litige <\/h3>\n\n\n\n<p>\u00ab\u00a0Impossible\u00a0!\u00a0\u00bb conteste le couple\u00a0: ce bateau constitue leur r\u00e9sidence principale et le confisquer est une ing\u00e9rence dans leur vie priv\u00e9e et familiale\u2026 et une condamnation p\u00e9nale doit \u00eatre proportionn\u00e9e, rappelle le couple\u00a0: les priver de leur habitation est abusif. L\u2019administration rel\u00e8ve pourtant que le couple n\u2019a jamais indiqu\u00e9 habiter le bateau avant sa confiscation et qu\u2019il est \u00e9galement usufruitier d\u2019une maison. Quant \u00e0 savoir si la confiscation du bateau est une sanction proportionn\u00e9e, il suffit, selon l\u2019administration, de constater la gravit\u00e9 des faits\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>Ce que confirme le juge, qui valide la sanction et ajoutant que le caract\u00e8re principal ou non de la r\u00e9sidence n\u2019a que peu d\u2019importance face \u00e0 l\u2019ampleur du butin et des moyens frauduleux mis en \u0153uvre.<\/p>\n\n\n\n<blockquote class=\"wp-block-quote is-layout-flow
