C\u2019est l\u2019histoire d\u2019un propri\u00e9taire qui se sent partout chez lui\u2026<\/em><\/strong><\/em><\/strong><\/h3>\n\n\n\n

Un propri\u00e9taire fait construire 2 extensions et une annexe \u00e0 sa maison. Probl\u00e8me : ces constructions sont faites sans aucune autorisation d\u2019urbanisme et de surcro\u00eet sur un terrain appartenant \u00e0 la commune\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

Lorsqu\u2019elle s\u2019en aper\u00e7oit, celle-ci demande la destruction de ces nouvelles constructions. Et tant qu\u2019il y est, le propri\u00e9taire doit \u00e9galement d\u00e9truire sa maison qui a \u00e9t\u00e9 construite dans les m\u00eames conditions. Mais c\u2019\u00e9tait il y a longtemps, conteste le propri\u00e9taire, et la commune a laiss\u00e9 passer le d\u00e9lai lui permettant d\u2019en r\u00e9clamer la destruction. Sauf que la maison et ses extensions constituent aujourd\u2019hui un ensemble indivisible qui doit \u00eatre d\u00e9truit dans son enti\u00e8ret\u00e9, m\u00eame si la maison n\u2019\u00e9tait pas initialement vis\u00e9e par la proc\u00e9dure, estime la commune\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

Ce que r\u00e9fute le juge : rien ne d\u00e9montrant que la maison ne puisse pas persister sans ses extensions, la prescription relative \u00e0 sa construction est donc bien acquise et seules les nouvelles constructions doivent \u00eatre d\u00e9truites.<\/p>\n\n\n\n
