Un particulier signe un devis portant sur l\u2019entretien de quelques parcelles de for\u00eat avec une soci\u00e9t\u00e9. Estimant que les travaux n\u2019ont pas \u00e9t\u00e9 correctement r\u00e9alis\u00e9s, il engage une action devant le juge afin d\u2019\u00eatre indemnis\u00e9. \u00ab Impossible ! \u00bb, selon la soci\u00e9t\u00e9\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

Selon elle, en effet, rien ne prouve qu\u2019il soit bien propri\u00e9taire des parcelles sur lesquelles la prestation a \u00e9t\u00e9 effectu\u00e9e. Il ne peut donc pas justifier d\u2019un int\u00e9r\u00eat \u00e0 agir devant le juge. Ce qui est pourtant n\u00e9cessaire pour porter une action en justice\u2026 \u00ab Possible ! \u00bb, maintient le particulier, qui rappelle que m\u00eame s\u2019il n\u2019a pas rapport\u00e9 la preuve de sa qualit\u00e9 de propri\u00e9taire, il a tout de m\u00eame un contrat conclu avec la soci\u00e9t\u00e9. Ce qui lui suffit pour agir en r\u00e9paration de son pr\u00e9judice r\u00e9sultant de la mauvaise ex\u00e9cution du contrat\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

\u00ab Possible ! \u00bb, confirme le juge, qui rappelle que l\u2019action en justice est ouverte \u00e0 tous ceux qui ont un int\u00e9r\u00eat \u00ab l\u00e9gitime \u00bb \u00e0 agir. Ce qui est le cas avec un simple contrat avec le professionnel\u2026<\/p>\n\n\n\n
