C\u2019est l\u2019histoire d\u2019un bailleur pour qui le temps n\u2019est pas extensible\u2026<\/em><\/strong><\/em><\/strong><\/em><\/strong><\/h3>\n\n\n\n

Parce qu\u2019ils constatent un \u00e9cart de superficie entre ce qui est inscrit sur le bail et la surface r\u00e9elle de leur logement, des locataires r\u00e9clament \u00e0 leur propri\u00e9taire, par courrier recommand\u00e9 avec AR, une diminution du loyer. M\u00eame si la propri\u00e9taire r\u00e9pond au courrier, elle est muette sur cette demande\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

Ils d\u00e9cident alors de faire appel au juge\u2026 \u00ab\u00a0Trop tard\u00a0!\u00a0\u00bb, r\u00e9torque la propri\u00e9taire\u00a0: selon elle, les locataires avaient 4 mois \u00e0 compter de leur demande pour saisir le juge. Or, il s\u2019est \u00e9coul\u00e9 presque 6 mois entre leur courrier recommand\u00e9 et leur saisine du juge. \u00ab\u00a0Dans les temps\u00a0!\u00a0\u00bb, selon les locataires\u00a0: pour eux, la r\u00e9ponse incompl\u00e8te de la propri\u00e9taire a permis de faire courir un nouveau d\u00e9lai de 4 mois, ce qui fait que le juge a finalement bien \u00e9t\u00e9 saisi dans les temps\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

\u00ab\u00a0Hors d\u00e9lai\u00a0!\u00a0\u00bb, tranche le juge\u00a0: l\u2019absence de r\u00e9ponse du bailleur sur la question de la diminution du loyer ne permet pas de faire d\u00e9marrer un nouveau d\u00e9lai de 4 mois\u2026 Leur demande est donc irrecevable\u00a0!<\/p>\n\n\n\n
