C\u2019est l\u2019histoire d\u2019un couple qui n\u2019aime pas \u00eatre r\u00e9veill\u00e9 par le chant du coq\u2026<\/em><\/strong><\/em><\/strong><\/em><\/strong><\/h3>\n\n\n\n

Un couple se plaint aupr\u00e8s de son voisin du chant de ses coqs au matin, trop bruyants \u00e0 son go\u00fbt. Ce qui l\u2019emp\u00eache de dormir\u2026Face \u00e0 l\u2019inaction de son voisin, il lui r\u00e9clame des indemnit\u00e9s pour trouble anormal de voisinage\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

Le couple rappelle qu\u2019il est g\u00ean\u00e9 par le chant des coqs au matin, m\u00eame lorsque les fen\u00eatres et les volets de sa chambre sont ferm\u00e9s. Et cette g\u00eane est encore plus importante en \u00e9t\u00e9, lorsqu’il dort les fen\u00eatres ouvertes. Pour preuve, il a fait appel \u00e0 un huissier qui, dans son constat, fait \u00e9tat du niveau particuli\u00e8rement sonore des coqs. Un niveau sonore mesur\u00e9 en ext\u00e9rieur, rel\u00e8ve le voisin, alors que le couple se plaint d\u2019un niveau sonore g\u00eanant en int\u00e9rieur\u2026Et un niveau sonore mesur\u00e9 \u00e0 diff\u00e9rentes heures de la journ\u00e9e, alors que le couple se plaint sp\u00e9cifiquement d\u2019une g\u00eane au petit matin\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

Ce qui am\u00e8ne le juge \u00e0 consid\u00e9rer que le constat d\u2019huissier ne d\u00e9montre pas que le chant des coqs constitue ici un trouble anormal de voisinage. Il donne donc raison au voisin !<\/p>\n\n\n\n
