Proposition qu\u2019accepte le salari\u00e9 3 jours plus tard\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"l-objet-du-litige\">L\u2019objet du litige <\/h3>\n\n\n\n<p>L\u2019employeur revient finalement sur sa d\u00e9cision et informe le salari\u00e9, le 25 janvier, qu\u2019il n\u2019est plus licenci\u00e9. \u00ab\u00a0Impossible\u00a0!\u00a0\u00bb, conteste le salari\u00e9\u00a0: lorsque le CSP est accept\u00e9, le contrat de travail est d\u00e9finitivement rompu. L\u2019employeur ne peut pas se r\u00e9tracter\u2026 \u00ab\u00a0Possible\u00a0!\u00a0\u00bb, conteste l\u2019employeur\u00a0: m\u00eame si le salari\u00e9 a accept\u00e9 le CSP, la rupture du contrat de travail n\u2019intervient qu\u2019\u00e0 l\u2019expiration d\u2019un d\u00e9lai de r\u00e9flexion de 21 jours. Or, vu qu\u2019il a inform\u00e9 le salari\u00e9 de sa d\u00e9cision avant l\u2019expiration de ce d\u00e9lai, sa r\u00e9tractation est valable\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>\u00ab&nbsp;Impossible ici&nbsp;!&nbsp;\u00bb,tranche le juge&nbsp;: d\u00e8s lors que le salari\u00e9 a adh\u00e9r\u00e9 au CSP, l\u2019employeur ne peut pas renoncer \u00e0 la rupture du contrat de travail.
