C\u2019est l\u2019histoire d\u2019un conducteur qui fait face \u00e0 un accident (et un assureur) complexe\u2026<\/em><\/strong><\/em><\/strong><\/h3>\n\n\n\n

Un conducteur de scooter est heurt\u00e9 par une voiture. \u00c9ject\u00e9 de son deux-roues, il atterrit sur une 2e<\/sup> voiture tandis que son scooter ach\u00e8ve sa course en percutant un 3e<\/sup> v\u00e9hicule, stationn\u00e9 plus loin. Son assureur assigne les compagnies d\u2019assurance des 3 v\u00e9hicules pour obtenir leur contribution\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

\u00ab\u00a0Je ne vous dois rien\u00a0!\u00a0\u00bb, objecte l\u2019assureur du v\u00e9hicule stationn\u00e9\u00a0: selon lui, il n\u2019a pas \u00e0 contribuer \u00e0 l\u2019indemnisation du conducteur \u00e9tant donn\u00e9 que le v\u00e9hicule de son assur\u00e9 \u00e9tait stationn\u00e9 plus loin et n\u2019a inflig\u00e9 ni blessure \u00e0 la victime, ni dommage \u00e0 son scooter, d\u00e9j\u00e0 percut\u00e9 par une autre voiture.\u00ab\u00a0Peu importe\u00a0!\u00a0\u00bb, r\u00e9plique l\u2019assureur de la victime\u00a0: il n\u2019en demeure pas moins que le v\u00e9hicule est impliqu\u00e9 dans cet accident\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

\u00ab\u00a0Vrai\u00a0!\u00a0\u00bb, tranche le juge\u00a0: qu\u2019importe que le v\u00e9hicule, stationn\u00e9, n\u2019ait pas jou\u00e9 de r\u00f4le dans la r\u00e9alisation de l\u2019accident. Comme le scooter l\u2019a percut\u00e9e, la voiture est bien impliqu\u00e9e dans cet accident complexe\u2026et son assureur devra apporter sa contribution\u00a0!<\/p>\n\n\n\n
