C\u2019est l\u2019histoire d\u2019un aidant familial qui ne l\u2019est pas vraiment\u2026<\/em><\/strong><\/h3>\n\n\n\n

3 aidants familiaux d\u2019une jeune femme en situation de handicap r\u00e9clament une prestation visant \u00e0 les indemniser pour l\u2019aide qu\u2019ils lui apportent\u00a0: sa m\u00e8re, son beau-p\u00e8re (2d<\/sup> \u00e9poux de sa m\u00e8re) et la m\u00e8re de son beau-p\u00e8re\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

\u00ab\u00a0Oui\u00a0!\u00a0\u00bb, r\u00e9pond le conseil d\u00e9partemental pour les 2 premi\u00e8res demandes et \u00ab\u00a0Non\u00a0!\u00a0\u00bb, poursuit-il, pour celle formul\u00e9e par la m\u00e8re du beau-p\u00e8re. Pour lui, elle ne peut pas avoir l\u00e9galement la qualit\u00e9 d\u2019aidant familial, faute de faire partie de la liste des personnes habilit\u00e9es \u00e0 l\u2019\u00eatre. Sauf que ce statut n\u2019est pas limit\u00e9 au seul lien de parent\u00e9, conteste cette derni\u00e8re\u00a0: selon elle, une personne, m\u00eame non professionnelle peut aussi avoir ce statut lorsqu\u2019elle vient en aide \u00e0 titre principal, \u00e0 une personne d\u00e9pendante de son entourage. Ce qui est ici son cas\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

Un argument qui ne convainc toutefois pas le juge\u00a0: la liste des personnes pouvant avoir le statut d\u2019aidant familial ne pr\u00e9voyant en effet pas son cas, le juge ne peut que rejeter sa demande d\u2019indemnisation.<\/p>\n\n\n\n
