C\u2019est l\u2019histoire d\u2019une m\u00e8re, d\u2019un enfant et de\u2026 deux p\u00e8res\u2026<\/em><\/strong><\/em><\/strong><\/em><\/strong><\/em><\/strong><\/em><\/strong><\/em><\/strong><\/em><\/strong><\/h3>\n\n\n\n

Un mari est inform\u00e9 par son \u00e9pouse qu\u2019il n\u2019est pas le p\u00e8re biologique de l\u2019enfant qu\u2019elle porte. \u00c0 sa naissance, elle d\u00e9clare pourtant l\u2019enfant comme \u00e9tant issu du mariage, divorce de son mari (d\u00e9clar\u00e9 comme p\u00e8re) et se remarie avec le p\u00e8re biologique de l\u2019enfant\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

\u00c9motionnellement atteint par la situation, l\u2019ex-mari attaque son ex-femme pour faire valoir son pr\u00e9judice moral. Mais son ex-femme affirme qu\u2019elle ne pouvait pas \u00eatre s\u00fbre \u00e0 100\u00a0% de qui \u00e9tait le p\u00e8re et qu\u2019elle a donc simplement appliqu\u00e9 la r\u00e8gle selon laquelle un \u00e9poux est toujours pr\u00e9sum\u00e9 \u00eatre le p\u00e8re d\u2019un enfant n\u00e9 pendant le mariage. Et lorsqu\u2019elle s\u2019est remari\u00e9e avec le p\u00e8re biologique, rien ne les obligeait \u00e0 r\u00e9tablir la v\u00e9rit\u00e9 sur la filiation de l\u2019enfant. Sauf qu\u2019en laissant planer le doute, les nouveaux \u00e9poux ont provoqu\u00e9 une situation de d\u00e9tresse, indemnisable selon l\u2019ex-mari\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

\u00c0 raison, confirme le juge pour qui l\u2019inertie des nouveaux \u00e9poux a contribu\u00e9 \u00e0 causer \u00e0 l\u2019ex-mari un pr\u00e9judice moral\u2026 indemnisable\u00a0!<\/p>\n\n\n\n
