C\u2019est l\u2019histoire d\u2019une d\u00e9funte au testament qui s\u00e8me le trouble\u2026<\/em><\/strong><\/h3>\n\n\n\n

Une personne d\u00e9c\u00e8de, laissant derri\u00e8re elle ses fr\u00e8re et s\u0153ur\u2026 et un l\u00e9gataire universel\u00a0! Un testament dactylographi\u00e9, sign\u00e9 par la d\u00e9funte, avait en effet \u00e9t\u00e9 remis \u00e0 son notaire, un peu plus d\u2019un an avant son d\u00e9c\u00e8s\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

Testament dont la validit\u00e9 est contest\u00e9e par les h\u00e9ritiers qui demandent au juge son annulation. \u00ab\u00a0Comment peut-on s\u2019assurer de la validit\u00e9 du consentement\u00a0?\u00a0\u00bb, s\u2019\u00e9tonnent les h\u00e9ritiers\u00a0: la d\u00e9funte souffrait, en effet, d\u2019une maladie neurod\u00e9g\u00e9n\u00e9rative la privant de l\u2019acuit\u00e9 visuelle n\u00e9cessaire pour lire des caract\u00e8res dactylographi\u00e9s. Le testament ne peut qu\u2019\u00eatre annul\u00e9, selon eux. \u00ab\u00a0Mais le notaire a valid\u00e9 le document avec elle\u00a0! \u00bb, r\u00e9torque le l\u00e9gataire, ce qui suffit \u00e0 le rendre valable. Du moins selon lui\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

Mais pas selon le juge, qui annule le testament\u00a0! Pour lui, \u00e0 d\u00e9faut d\u2019autre \u00e9l\u00e9ment concret permettant de prouver la fa\u00e7on dont elle aurait pu effectivement prendre connaissance du contenu du document, il est impossible de s\u2019assurer de ses derni\u00e8res volont\u00e9s.<\/p>\n\n\n\n
