Une personne \u00e2g\u00e9e ayant pris des dispositions g\u00e9n\u00e9reuses au b\u00e9n\u00e9fice de ses 2 filles et de son petit-fils fait l\u2019objet d\u2019une proc\u00e9dure de mise sous curatelle renforc\u00e9e demand\u00e9e par\u2026 ceux-l\u00e0 m\u00eame qu\u2019elle affectionne. Mesure accord\u00e9e, mais sous la forme d\u2019une tutelle\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

\u00ab Pourquoi ? \u00bb, s\u2019interrogent et contestent les int\u00e9ress\u00e9s : si les certificats m\u00e9dicaux attestent que ses facult\u00e9s intellectuelles et mentales sont alt\u00e9r\u00e9es, ce n\u2019est que dans une moindre mesure. \u00ab Elle est vuln\u00e9rable et influen\u00e7able ! \u00bb, estime le juge des tutelles : pour preuve, elle a r\u00e9alis\u00e9 de nombreuses donations au b\u00e9n\u00e9fice des demandeurs, se sentant redevable de l\u2019affection qu\u2019ils lui portent. Et vu l\u2019importance de son patrimoine, une curatelle renforc\u00e9e n\u2019est pas suffisante pour la prot\u00e9ger, selon lui\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

\u00ab Suffisant ! \u00bb, tranche le juge : pour placer quelqu\u2019un sous tutelle, il faut prouver qu\u2019elle a besoin d\u2019\u00eatre repr\u00e9sent\u00e9e de mani\u00e8re continue dans les actes de la vie civile. Ce qui n\u2019est pas caract\u00e9ris\u00e9 ici !<\/p>\n\n\n\n
