C\u2019est l\u2019histoire de voisins qui n\u2019aiment pas le changement\u2026<\/em><\/strong><\/em><\/strong><\/h3>\n\n\n\n

Les propri\u00e9taires d\u2019une villa situ\u00e9e dans un lotissement voient arriver d\u2019un mauvais \u0153il leur nouveau voisin, une soci\u00e9t\u00e9 civile immobili\u00e8re (SCI) : celle-ci entreprend en effet la construction d\u2019un immeuble de 6 logements, avec piscine. Ce qui n\u2019est pas de leur go\u00fbt\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

Et parce qu\u2019ils d\u00e9couvrent que l\u2019implantation de l\u2019immeuble exc\u00e8de l\u2019emprise au sol maximale pr\u00e9vue par le cahier des charges du lotissement, ils r\u00e9clament sa d\u00e9molition. Une demande bien trop disproportionn\u00e9e, pour la SCI : m\u00eame si elle admet ne pas avoir respect\u00e9 le cahier des charges, celui-ci autorise la construction d\u2019\u00e9difices importants et n\u2019interdit pas les constructions collectives, pour autant qu\u2019ils ne g\u00e2chent pas la vue des voisins\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

Ce qui est le cas ici, constate le juge, pour qui l\u2019immeuble est construit dans l\u2019esprit du r\u00e8glement du lotissement et n\u2019occasionne aucune perte de vue, ni aucun vis-\u00e0-vis. Pour lui, le simple ressenti n\u00e9gatif des voisins ne peut justifier, ici, la d\u00e9molition de l\u2019immeuble !<\/p>\n\n\n\n
