Ce qui fait basculer son logement dans la cat\u00e9gorie \u00ab\u00a0ind\u00e9cent\u00a0\u00bb, selon elle\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"l-objet-du-litige\">L\u2019objet du litige <\/h3>\n\n\n\n<p>S\u2019estimant victime d\u2019un pr\u00e9judice, elle r\u00e9clame une indemnit\u00e9 \u00e0 son bailleur\u00a0: un logement ne peut, en effet, pas \u00eatre consid\u00e9r\u00e9 comme d\u00e9cent s\u2019il ne fait pas au moins 9 m\u00b2 avec 2,20 m\u00e8tres de hauteur sous plafond ou s\u2019il ne dispose pas d\u2019un volume habitable au moins \u00e9gal \u00e0 20 m<sup>3<\/sup>, rappelle-t-elle. Or, son appartement dispose d\u2019une surface habitable de 8,11 m\u00b2 et d\u2019un volume habitable de 18,73 m<sup>3<\/sup>. Ce qui est donc insuffisant\u2026 \u00ab\u00a0Diff\u00e9rence minime\u00a0!\u00a0\u00bb, lui r\u00e9pond le propri\u00e9taire, qui refuse de l\u2019indemniser\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\" id=\"le-verdict\">Le verdict <\/h3>\n\n\n\n<p>\u00ab\u00a0Peu importe\u00a0\u00bb, tranche le juge\u00a0: si la surface du logement lou\u00e9 n\u2019atteint pas celle pr\u00e9vue par la r\u00e9glementation, il doit \u00eatre qualifi\u00e9 d\u2019\u00ab\u00a0ind\u00e9cent\u00a0\u00bb.
