{"id":23395,"date":"2022-07-20T17:01:00","date_gmt":"2022-07-20T15:01:00","guid":{"rendered":"https:\/\/avoloi.fr\/blog\/?p=23395"},"modified":"2022-06-27T17:10:55","modified_gmt":"2022-06-27T15:10:55","slug":"licenciement-abusif-bareme","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/licenciement-abusif-bareme\/","title":{"rendered":"Licenciement abusif\u00a0: le bar\u00e8me Macron valid\u00e9 par la Cour de cassation"},"content":{"rendered":"<p>Controvers\u00e9, le bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb fait l\u2019objet de critiques en raison, notamment, de ses plafonds d\u2019indemnisation pour <a href=\"https:\/\/avoloi.fr\/blog\/licenciement-economique\/\">licenciement<\/a> injustifi\u00e9 trop faibles pour les salari\u00e9s b\u00e9n\u00e9ficiant de peu d\u2019anciennet\u00e9. \u00c0 travers ses deux arr\u00eats du 11 mai 2022, la <a href=\"https:\/\/avoloi.fr\/blog\/arret-de-la-cour-de-cassation-au-secours-des-gardiens-dimmeubles-victimes-de-harcelement-moral\/\">Cour de cassation<\/a> vient donc se positionner officiellement sur la validit\u00e9 du bar\u00e8me.<\/p>\n<h2><strong>Qu\u2019est-ce que le bar\u00e8me Macron\u00a0?<\/strong><\/h2>\n<p>Lorsqu\u2019un salari\u00e9 estime \u00eatre victime d\u2019un pr\u00e9judice en raison de la rupture abusive de son contrat de travail, il dispose d\u2019un d\u00e9lai d\u2019un an pour contester son licenciement devant le conseil de prud\u2019hommes.<\/p>\n<p>Si le juge consid\u00e8re que la rupture du <a href=\"https:\/\/avoloi.fr\/blog\/contrat-obseques-souscrire\/\">contrat<\/a> du salari\u00e9 est injustifi\u00e9e, le licenciement devient sans cause r\u00e9elle et s\u00e9rieuse. Le salari\u00e9 est alors en droit de r\u00e9clamer que lui soit allou\u00e9e une indemnit\u00e9 compensatrice du pr\u00e9judice mat\u00e9riel et moral subi du fait de la rupture abusive de son contrat de travail. La somme accord\u00e9e par la juridiction prud\u2019homale \u00e0 titre de dommages et int\u00e9r\u00eats aux d\u00e9pens de l\u2019employeur ne doit pas \u00eatre confondue avec l\u2019indemnit\u00e9 l\u00e9gale de licenciement.<\/p>\n<p>En pr\u00e9sence d\u2019un licenciement sans cause r\u00e9elle et s\u00e9rieuse, le juge des prud\u2019hommes d\u00e9termine l\u2019\u00e9tendue du pr\u00e9judice \u00e9prouv\u00e9 par le salari\u00e9. Toutefois, depuis l\u2019entr\u00e9e en vigueur des ordonnances dites \u00ab\u00a0Macron\u00a0\u00bb du 22 septembre 2017, les indemnit\u00e9s prud&rsquo;homales sont calcul\u00e9es sur la base du bar\u00e8me instaur\u00e9 \u00e0 <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000036762052\/\">l\u2019article L1235-3 du Code du travail.<\/a> L\u2019encadrement l\u00e9gal de ces indemnit\u00e9s accord\u00e9es pour licenciement abusif contraint, en cons\u00e9quence, les juges du fond \u00e0 fixer le montant des dommages et int\u00e9r\u00eats dans les limites minimum et maximum impos\u00e9es par le Code du travail.<\/p>\n<p>Le montant des indemnit\u00e9s prud&rsquo;homales d\u00e9pend toujours de la situation du salari\u00e9. Le bar\u00e8me \u00ab\u00a0Macron\u00a0\u00bb impose la prise en compte de deux facteurs\u00a0: l&rsquo;anciennet\u00e9 du salari\u00e9 exprim\u00e9e en ann\u00e9es compl\u00e8tes et le nombre d\u2019employ\u00e9s dans l&rsquo;entreprise.<\/p>\n<p>De fait, en cas de licenciement abusif au sein d\u2019une entreprise comprenant moins de 11 salari\u00e9s, l\u2019employ\u00e9 doit justifier de plus de 10 ans d&rsquo;anciennet\u00e9 pour atteindre un montant minimum de dommages et int\u00e9r\u00eats \u00e9quivalent \u00e0 3 mois de salaires. En revanche, 2 ans d\u2019anciennet\u00e9 suffisent pour pr\u00e9tendre \u00e0 ce m\u00eame montant plancher dans une entreprise de 11 salari\u00e9s et plus.
