Les derni\u00e8res d\u00e9cisions judiciaires se fondent, en effet, sur le moyen tir\u00e9 de la perte de la chose lou\u00e9e pour accorder le remboursement des loyers vers\u00e9s par les preneurs alors qu\u2019ils se trouvaient dans l\u2019impossibilit\u00e9 d\u2019exploiter leurs fonds de commerce dans les lieux pris en location.<\/p>\n<h2><strong>Pourquoi retenir le fondement de la perte partielle de la chose lou\u00e9e\u00a0?<\/strong><\/h2>\n<p>Plusieurs d\u00e9cisions judiciaires confirment d\u00e9sormais que <strong>la perte partielle de la chose lou\u00e9e<\/strong> constitue, pour les preneurs plac\u00e9s un temps dans l\u2019impossibilit\u00e9 d\u2019exploiter leurs locaux commerciaux en raison de la pand\u00e9mie de<a href=\"https:\/\/avoloi.fr\/blog\/egalite-acces-soins\/\"> Covid-19<\/a>, un argument de d\u00e9fense valable pour s\u2019exon\u00e9rer du paiement des <a href=\"https:\/\/avoloi.fr\/blog\/encadrement-des-loyers\/\">loyers<\/a> exig\u00e9s malgr\u00e9 tout par les bailleurs.<\/p>\n<p>Aux termes de l\u2019article 1722 du Code civil, la loi pr\u00e9voit la r\u00e9siliation du bail en cas de destruction totale des biens lou\u00e9s. Leur destruction partielle, entra\u00eenant une diminution sensible de leur usage, peut en revanche donner lieu \u00e0 <strong>une baisse du prix du loyer<\/strong>. La notion de perte de la chose lou\u00e9e s\u2019entend, par ailleurs, de toutes les circonstances pouvant entraver, de mani\u00e8re <strong>d\u00e9finitive ou temporaire<\/strong>, l\u2019usage du bien. La jurisprudence admet ainsi que la perte de la chose lou\u00e9e puisse r\u00e9sulter d\u2019une privation de jouissance d\u2019origine <strong>mat\u00e9rielle<\/strong> mais \u00e9galement <strong>juridique<\/strong>, ce qui peut \u00eatre le cas lorsque le preneur se trouve emp\u00each\u00e9 d\u2019acc\u00e9der au bien lou\u00e9 en raison d\u2019une d\u00e9cision administrative.<\/p>\n<p>Toutefois, la crise sanitaire est venue quelque peu modifier les rapports entre bailleurs et preneurs. Pendant la p\u00e9riode de l\u2019\u00e9tat d\u2019urgence sanitaire, des mesures gouvernementales ont en effet interdit au public l\u2019acc\u00e8s \u00e0 certains \u00e9tablissements et d\u00e9cid\u00e9 de mani\u00e8re exceptionnelle la fermeture administrative de commerces jug\u00e9s alors non essentiels. Les preneurs contraints de fermer leurs commerces n\u2019ont, par cons\u00e9quent, pu exercer leur activit\u00e9 dans les locaux pris \u00e0 bail pour la p\u00e9riode comprise entre le 15 mars et le 11 mai 2020.<\/p>\n<p>Bien que pr\u00e9vue pour une dur\u00e9e limit\u00e9e, l\u2019impossibilit\u00e9 juridique d\u2019user de la chose lou\u00e9e conform\u00e9ment \u00e0 sa destination pendant cette p\u00e9riode n\u2019en est pas moins absolue. Il s\u2019agit donc bien, pour certains juges du fonds, d\u2019une perte partielle de la chose lou\u00e9e au sens de l\u2019article 1722 du Code civil pouvant conduire \u00e0 une diminution du prix, c\u2019est-\u00e0-dire d\u2019une <strong>dispense de paiement du loyer<\/strong>.<\/p>\n<p>De fait, \u00e0 l\u2019instar de la Cour d\u2019appel de Paris \u00e0 travers ses d\u00e9cisions des 30 mars et 21 avril 2022, l\u2019actuelle tendance jurisprudentielle majoritaire accepte la perte partielle de la chose lou\u00e9e comme fondement \u00e0 la demande des preneurs en exon\u00e9ration des loyers concern\u00e9s par la p\u00e9riode de fermeture administrative.<\/p>\n<h2><strong>Quelles sont les cons\u00e9quences de la perte de la chose lou\u00e9e pour les bailleurs\u00a0?<\/strong><\/h2>\n<p>En soutien aux preneurs affect\u00e9s par la fermeture administrative impos\u00e9e par la pand\u00e9mie, certains <a href=\"https:\/\/avoloi.fr\/blog\/bailleurs-negocier-a-la-baisse-les-loyers-a-la-demande-du-locataire\/\">bailleurs<\/a> ont accept\u00e9 de renoncer partiellement ou en totalit\u00e9 au versement des loyers dus pendant la p\u00e9riode concern\u00e9e. D\u2019autres ont propos\u00e9 un report ou un \u00e9chelonnement de ces sommes apr\u00e8s reprise de leur activit\u00e9. Certains, enfin, ont pr\u00e9f\u00e9r\u00e9 poursuivre en justice les preneurs dans le but d\u2019obtenir le paiement int\u00e9gral de leurs loyers.<\/p>\n<p>Les derni\u00e8res d\u00e9cisions jurisprudentielles admettant l\u2019argument de la perte de la chose lou\u00e9e pour justifier du non-paiement de tout ou partie des loyers accordent, par cons\u00e9quent, aux preneurs une dispense de loyers pendant la p\u00e9riode de confinement.<\/p>\n<p>Or, l\u2019impact de ces d\u00e9cisions sur les loyers per\u00e7us pendant les p\u00e9riodes de fermeture administrative n\u2019est pas anodin. Pour les bailleurs qui sont parvenus \u00e0 contraindre les preneurs au paiement de leurs loyers et ceux qui ont accept\u00e9 de conc\u00e9der quelques am\u00e9nagements en vue du paiement des sommes dues, ces d\u00e9cisions repr\u00e9sentent une r\u00e9elle menace. Une exon\u00e9ration de loyers obligerait, en effet, les bailleurs <strong>au remboursement des sommes<\/strong> alors ind\u00fbment per\u00e7ues aupr\u00e8s des preneurs impact\u00e9s par la fermeture administrative des commerces non essentiels. Elle ouvrirait ainsi la porte \u00e0<strong> une s\u00e9rie d\u2019actions en justice visant au remboursement des loyers vers\u00e9s<\/strong> en d\u00e9pit d\u2019une perte partielle de la chose lou\u00e9e.<\/p>\n<p>La position de la Cour de cassation sur la question de savoir si la fermeture administrative impos\u00e9e lors du premier confinement aux commerces non essentiels constitue ou non une perte partielle de la chose lou\u00e9e sera de fait primordial. Dans cette attente, il est vivement recommand\u00e9 aux bailleurs concern\u00e9s par la perception de tels loyers litigieux de proc\u00e9der \u00e0 un \u00e9tat des lieux de leur situation et de faire r\u00e9aliser, si besoin, une \u00e9valuation de leur risque par un professionnel des baux commerciaux.<\/p>\n<p><em>Image :Photo de <a
