{"id":23321,"date":"2022-06-17T09:16:00","date_gmt":"2022-06-17T07:16:00","guid":{"rendered":"https:\/\/avoloi.fr\/blog\/?p=23321"},"modified":"2022-06-08T09:31:21","modified_gmt":"2022-06-08T07:31:21","slug":"bail-de-colocation","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/bail-de-colocation\/","title":{"rendered":"Bail de colocation\u00a0: bail unique, baux multiples et encadrement des loyers"},"content":{"rendered":"<p>Particuli\u00e8rement ouverte aux \u00e9tudiants et aux jeunes actifs, la colocation s\u00e9duit par ses avantages\u00a0: logement plus grand, frais partag\u00e9s&#8230; Si son objet reste la location \u00e0 plusieurs d\u2019un logement commun, la colocation peut n\u00e9anmoins rev\u00eatir diff\u00e9rentes formes juridiques.<\/p>\n<h2><strong>Les principales caract\u00e9ristiques de la colocation<\/strong><\/h2>\n<p>Consacr\u00e9e par la loi ALUR du 24 mars 2014, la colocation est la prise \u00e0 bail, \u00e0 titre d\u2019habitation principale, d&rsquo;un m\u00eame logement par plusieurs locataires. La colocation se mat\u00e9rialise soit par la conclusion d\u2019un contrat unique sign\u00e9 par tous les occupants du logement, soit par l\u2019\u00e9tablissement pour chaque colocataire d\u2019un contrat de bail individuel avec le propri\u00e9taire.<\/p>\n<h3><strong>Le contrat de bail unique ou bail commun<\/strong><\/h3>\n<p>Dans le cadre d\u2019un bail commun ou bail collectif, <strong>un seul et unique contrat de bail<\/strong> est sign\u00e9 entre le propri\u00e9taire et l\u2019ensemble des colocataires. Le bailleur est, en ce cas, en droit de r\u00e9clamer le paiement de l\u2019int\u00e9gralit\u00e9 du loyer en un seul versement, \u00e0 charge pour les colocataires de rassembler leurs quotes-parts respectives en vue de r\u00e9gler la totalit\u00e9 de la somme correspondante.<\/p>\n<p>Afin de se pr\u00e9munir contre les impay\u00e9s de <a href=\"https:\/\/avoloi.fr\/blog\/lencadrement-des-loyers\/\">loyers<\/a> ou de charges locatives, le propri\u00e9taire peut conditionner la colocation \u00e0 la production d\u2019<strong>une caution<\/strong>. L\u2019acte de cautionnement est sign\u00e9 au profit d\u2019un seul ou de plusieurs colocataires. En l\u2019absence de clause de solidarit\u00e9, chaque colocataire n&rsquo;est oblig\u00e9 que pour la part des loyers et charges locatives qui lui incombe jusqu\u2019\u00e0 la fin de son pr\u00e9avis. Le <a href=\"https:\/\/avoloi.fr\/blog\/bailleurs-negocier-a-la-baisse-les-loyers-a-la-demande-du-locataire\/\">bailleur<\/a> a \u00e9galement la possibilit\u00e9 d\u2019exiger le versement d\u2019<strong>un d\u00e9p\u00f4t de garantie<\/strong>, dont le montant peut \u00eatre r\u00e9parti entre tous les colocataires ou vers\u00e9 en totalit\u00e9 par l\u2019un d\u2019entre eux.<\/p>\n<p>L\u2019introduction, \u00e0 la demande du bailleur, d\u2019<strong>une clause de solidarit\u00e9<\/strong> dans le bail collectif impose \u00e0 chaque colocataire, ainsi qu\u2019\u00e0 leur \u00e9ventuelle caution, de s\u2019engager au paiement de la totalit\u00e9 des loyers et autres sommes dues au propri\u00e9taire en cas de d\u00e9faillance des autres colocataires. \u00c0 savoir que cet engagement de solidarit\u00e9 demeure valable 6 mois apr\u00e8s le d\u00e9part d\u2019un occupant, \u00e0 moins qu\u2019un nouveau colocataire ne prenne sa place dans le logement.<\/p>\n<p>L\u2019<strong>\u00e9tat des lieux d\u2019entr\u00e9e<\/strong> est \u00e9tabli et sign\u00e9 en pr\u00e9sence du propri\u00e9taire ainsi que de tous les colocataires. Un <strong>\u00e9tat des lieux de sortie<\/strong> est dress\u00e9 au d\u00e9part du dernier colocataire du logement. Chaque preneur \u00e0 bail est libre de quitter la colocation, sous r\u00e9serve de remettre son pr\u00e9avis en bonne et due forme. La colocation se poursuit alors avec le ou les autres signataires du bail sans pour autant modifier le montant total du loyer. Sauf \u00e0 trouver un arrangement avec les colocataires restants, la personne qui sort de la location en cours de bail ne peut pr\u00e9tendre au remboursement de son d\u00e9p\u00f4t de garantie avant l\u2019arriv\u00e9e \u00e0 \u00e9ch\u00e9ance du contrat de location. La restitution du <strong>d\u00e9p\u00f4t de garantie<\/strong> n\u2019a effectivement lieu qu\u2019au d\u00e9part du dernier colocataire, une fois les cl\u00e9s remises au propri\u00e9taire.<\/p>\n<h3><strong>Le contrat de bail individuel<\/strong><\/h3>\n<p>La <strong>colocation \u00e0 baux multiples<\/strong> se traduit par la conclusion d\u2019un contrat de bail individuel entre le propri\u00e9taire et chaque colocataire. Chacun des baux conclus ind\u00e9pendamment les uns des autres pr\u00e9cise les pi\u00e8ces du logement r\u00e9serv\u00e9es \u00e0 l\u2019usage privatif du colocataire, de m\u00eame que les parties communes \u00e0 tous les occupants.<\/p>\n<p>Chaque colocataire a donc pour obligation de <strong>s\u2019acquitter de son propre loyer<\/strong> et de ses charges locatives, sans solidarit\u00e9 de paiement avec les autres colocataires. Un <strong>d\u00e9p\u00f4t de garantie<\/strong> peut toutefois lui \u00eatre r\u00e9clam\u00e9 lors de son entr\u00e9e dans les lieux, ainsi que la pr\u00e9sentation d\u2019<strong>une caution<\/strong>. Chaque colocataire peut librement donner son pr\u00e9avis au bailleur et obtenir, \u00e0 son d\u00e9part, la restitution de son d\u00e9p\u00f4t de garantie selon les m\u00eames conditions qu\u2019un contrat de location classique. La colocation se poursuit au titre des autres baux en cours, \u00e0 charge pour le propri\u00e9taire de trouver un nouveau colocataire pour la partie du logement lib\u00e9r\u00e9e.<\/p>\n<h2><strong>L\u2019encadrement des loyers de colocation<\/strong><\/h2>\n<p>Dans les zones dites \u00ab\u00a0tendues\u00a0\u00bb, la fixation du prix de la colocation est soumise \u00e0 <strong>un dispositif d\u2019encadrement des loyers<\/strong> destin\u00e9 \u00e0 limiter l\u2019\u00e9volution des prix des locations des r\u00e9sidences principales. Depuis la loi <a href=\"https:\/\/avoloi.fr\/blog\/elan-reglement-copropriete\/\">ELAN<\/a> du 23 novembre 2018, certaines agglom\u00e9rations telles que Paris et Lille ont adopt\u00e9, \u00e0 titre d\u2019exp\u00e9rimentation, un encadrement suppl\u00e9mentaire des loyers en bloquant ceux-ci \u00e0 une valeur de r\u00e9f\u00e9rence major\u00e9e (valeur maximum). Cette exp\u00e9rimentation pr\u00e9vue initialement pour une dur\u00e9e de 5 ans est reconduite par la loi 3 DS du 21 f\u00e9vrier 2022 pour 3 ann\u00e9es, soit jusqu\u2019au 24 novembre 2026 afin, notamment, de permettre d\u2019\u00e9tendre le programme d\u2019encadrement des loyers \u00e0 d\u2019autres communes volontaires.<\/p>\n<p>La loi 3 DS pr\u00e9cise, en outre, que la somme globale per\u00e7ue au titre des loyers de la colocation <strong>ne doit pas exc\u00e9der le montant du loyer applicable au logement<\/strong> en raison de l\u2019encadrement des loyers, qu\u2019il
