{"id":23278,"date":"2022-06-08T16:25:00","date_gmt":"2022-06-08T14:25:00","guid":{"rendered":"https:\/\/avoloi.eu\/?p=23278"},"modified":"2022-06-02T12:35:36","modified_gmt":"2022-06-02T10:35:36","slug":"visites-medicales-travail","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/visites-medicales-travail\/","title":{"rendered":"Visites m\u00e9dicales au travail\u00a0: quels changements au 31 mars 2022\u00a0?"},"content":{"rendered":"<p>La loi du 2 ao\u00fbt 2021 en faveur du renforcement de la pr\u00e9vention en sant\u00e9 au travail et ses d\u00e9crets d\u2019application apportent diverses modifications, pour la plupart en vigueur depuis le 31 mars 2022, dans le suivi de l\u2019\u00e9tat de sant\u00e9 des salari\u00e9s. Certaines de ces dispositions concernent les visites m\u00e9dicales de pr\u00e9-reprise et de reprise destin\u00e9es \u00e0 accompagner l\u2019employ\u00e9 dans son retour au travail apr\u00e8s une longue absence. Un nouvel examen m\u00e9dical est, par ailleurs, instaur\u00e9&nbsp;: la visite de mi-carri\u00e8re.<\/p>\n<h2><strong>La visite de reprise<\/strong><\/h2>\n<p>\u00c0 l\u2019issue de son arr\u00eat de travail, un salari\u00e9 peut \u00eatre convoqu\u00e9 pour <strong>une visite m\u00e9dicale de reprise<\/strong>. Cette visite de reprise intervient de mani\u00e8re <strong>obligatoire<\/strong> lorsque celui-ci se trouve dans l\u2019une des situations \u00e9num\u00e9r\u00e9es par la loi, c\u2019est-\u00e0-dire au retour \u00e0 son poste apr\u00e8s une absence pour&nbsp;:<\/p>\n<ul>\n<li>cong\u00e9 de maternit\u00e9&nbsp;;<\/li>\n<li><a href=\"https:\/\/avoloi.eu\/contestation-accident-du-travail-les-regles-vont-changer\/\">accident du travail<\/a>, lorsque l\u2019arr\u00eat est de 30&nbsp;jours minimum&nbsp;;<\/li>\n<li>maladie professionnelle, sans condition de dur\u00e9e&nbsp;;<\/li>\n<li>accident ou maladie non professionnels ayant occasionn\u00e9 un arr\u00eat de travail sup\u00e9rieur \u00e0 60&nbsp;jours (d\u00e9lai ramen\u00e9 \u00e0 30&nbsp;jours pour les arr\u00eats d\u00e9but\u00e9s avant le 1er avril 2022).<\/li>\n<\/ul>\n<p>La visite de reprise est organis\u00e9e dans le but de s\u2019assurer que l\u2019\u00e9tat de sant\u00e9 de l\u2019employ\u00e9 ne pr\u00e9sente aucune incompatibilit\u00e9 avec son retour \u00e0 son poste de travail. Au cours de cette visite, le m\u00e9decin du travail peut en cons\u00e9quence \u00e9mettre des recommandations en faveur de mesures d\u2019am\u00e9nagements ou d\u2019adaptations de son poste afin de faciliter la reprise du travail par le salari\u00e9. Le cas \u00e9ch\u00e9ant, le m\u00e9decin du travail peut rendre un avis d\u2019inaptitude et se prononcer pour un reclassement professionnel de l\u2019employ\u00e9.<\/p>\n<p>Lorsqu\u2019elle fait suite \u00e0 une visite de pr\u00e9-reprise, la visite de reprise sert alors \u00e0 \u00e9valuer, selon la situation du salari\u00e9, la pertinence des am\u00e9nagements et adaptations pr\u00e9conis\u00e9s avant son <a href=\"https:\/\/avoloi.eu\/retourner-au-travail-en-toute-securite-apres-lepidemie-obligations-de-lemployeur-et-droits-du-salarie\/\">retour au travail<\/a> ou l\u2019opportunit\u00e9 du nouvel emploi propos\u00e9 dans le cadre de la proc\u00e9dure de reclassement.<\/p>\n<p>D\u00e8s lors que la date du retour au travail du salari\u00e9 lui a \u00e9t\u00e9 communiqu\u00e9e, l\u2019employeur a l\u2019obligation de contacter les services de pr\u00e9vention et de sant\u00e9 au travail (SPST) en vue d\u2019organiser la visite m\u00e9dicale de reprise. Le rendez-vous avec le m\u00e9decin du travail est <strong>id\u00e9alement fix\u00e9 au jour de la reprise effective du travail<\/strong> par l\u2019employ\u00e9. \u00c0 d\u00e9faut, la visite doit avoir lieu au plus tard dans les 8 jours suivant la date du retour \u00e0 l\u2019emploi.<\/p>\n<p>Les contestations inh\u00e9rentes \u00e0 l\u2019examen m\u00e9dical pratiqu\u00e9 par le m\u00e9decin du travail peuvent \u00eatre port\u00e9es par le salari\u00e9 comme l\u2019employeur devant le conseil de prud\u2019hommes. \u00c0 savoir que l\u2019employeur ne peut exiger la pr\u00e9sence du salari\u00e9 \u00e0 son poste de travail tant que la visite de reprise n\u2019a pas \u00e9t\u00e9 effectu\u00e9e. En revanche, le refus du salari\u00e9 de se pr\u00e9senter \u00e0 cet examen m\u00e9dical constitue une faute susceptible de conduire au licenciement du salari\u00e9.<\/p>\n<h2><strong>La visite de pr\u00e9-reprise<\/strong><\/h2>\n<p>Le salari\u00e9 en arr\u00eat de travail pour <strong>une dur\u00e9e sup\u00e9rieure \u00e0 30 jours<\/strong> peut b\u00e9n\u00e9ficier d\u2019<strong>une visite m\u00e9dicale de pr\u00e9-reprise<\/strong>. Cependant, la dur\u00e9e minimum requise pour les arr\u00eats de travail d\u00e9but\u00e9s ant\u00e9rieurement au 1er avril 2022 demeure de 3 mois.<\/p>\n<p>L\u2019objectif de cette visite, men\u00e9e par le m\u00e9decin du travail, est d\u2019accompagner le salari\u00e9 qui craint des difficult\u00e9s du fait de son \u00e9tat de sant\u00e9 lors de la reprise de son emploi, avant la fin de son arr\u00eat afin de favoriser autant que possible le maintien dans l&#8217;emploi du salari\u00e9.<\/p>\n<p>La visite de pr\u00e9-reprise permet ainsi de d\u00e9terminer si des am\u00e9nagements et adaptations du poste de travail de l\u2019employ\u00e9 peuvent \u00eatre envisag\u00e9s et d\u2019anticiper, si besoin, un reclassement professionnel en pr\u00e9conisant \u00e9ventuellement le suivi d\u2019une formation professionnelle.<\/p>\n<p>L\u2019organisation d\u2019une telle visite m\u00e9dicale ne dispense toutefois pas le salari\u00e9 d\u2019effectuer la visite de reprise obligatoire d\u00e8s son retour en entreprise. La visite de pr\u00e9-reprise, facultative, a donc lieu pendant l\u2019arr\u00eat de travail. Elle peut \u00eatre planifi\u00e9e \u00e0 la demande du salari\u00e9 lui-m\u00eame ou, sous conditions, du m\u00e9decin du travail, mais aussi \u00e0 l\u2019initiative du m\u00e9decin traitant ou du m\u00e9decin conseil de l\u2019Assurance maladie.<\/p>\n<h2><strong>La visite de mi-carri\u00e8re<\/strong><\/h2>\n<p>Depuis le 31 mars 2022, le Code du travail pr\u00e9voit un examen m\u00e9dical suppl\u00e9mentaire&nbsp;: <strong>la visite de mi-carri\u00e8re<\/strong>.
