{"id":23263,"date":"2022-06-01T15:14:00","date_gmt":"2022-06-01T13:14:00","guid":{"rendered":"https:\/\/avoloi.eu\/?p=23263"},"modified":"2022-06-01T10:49:11","modified_gmt":"2022-06-01T08:49:11","slug":"lencadrement-des-loyers","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/lencadrement-des-loyers\/","title":{"rendered":"L&rsquo;encadrement des loyers est maintenu \u00e0 Paris"},"content":{"rendered":"<p>Le Conseil d&rsquo;Etat vient de rejeter une demande de l\u2019Union nationale des propri\u00e9taires immobiliers (UNPI) et de la Chambre nationale des propri\u00e9taires qui d\u00e9siraient faire annuler le dispositif d&rsquo;encadrement des loyers dans la capitale fran\u00e7aise.<\/p>\n<h2><strong>En quoi consiste l&rsquo;encadrement des loyers \u00e0 Paris ?<\/strong><\/h2>\n<p><a href=\"https:\/\/www.legifrance.gouv.fr\/jorf\/id\/JORFTEXT000037639478\" target=\"_blank\" rel=\"noopener\">Institu\u00e9 par la loi ELAN du 23 novembre 2018<\/a>, le dispositif d&rsquo;<a href=\"https:\/\/avoloi.eu\/encadrement-des-loyers\/\">encadrement des loyers<\/a> pr\u00e9voit de <strong>plafonner le montant des loyers<\/strong> dans plusieurs grandes villes de France, dont Paris. Un loyer de r\u00e9f\u00e9rence est d\u00e9fini pour tous les types de biens immobiliers et par quartier afin d&rsquo;\u00e9tablir un plafond. Ce dernier peut \u00eatre <strong>major\u00e9 de 20% maximum<\/strong> en fonction de certaines conditions : vue du logement, conditions de confort ou localisation particuli\u00e8rement attrayante.<br \/>\nEn f\u00e9vrier 2022, un arr\u00eat\u00e9 d\u00e9cid\u00e9 en compl\u00e9ment de la loi <a href=\"https:\/\/avoloi.eu\/elan-reglement-copropriete\/\">ELAN<\/a> a rendu obligatoire l&rsquo;affichage du loyer de r\u00e9f\u00e9rence sur toutes les annonces immobili\u00e8res, permettant ainsi \u00e0 la personne qui loue le bien de savoir si le propri\u00e9taire reste dans le cadre de la loi ou s&rsquo;il loue son bien plus cher qu&rsquo;il ne devrait. L&rsquo;arr\u00eat\u00e9 pr\u00e9voyait l&rsquo;affichage de trois informations obligatoires :<\/p>\n<ul>\n<li><strong>Le loyer de r\u00e9f\u00e9rence<\/strong> en fonction du quartier et du bien immobilier ;<\/li>\n<li>Le <strong>montant du loyer de r\u00e9f\u00e9rence major\u00e9 de 20%<\/strong>, soit le plafond maximum autoris\u00e9 ;<\/li>\n<li>L&rsquo;existence d&rsquo;un <strong>compl\u00e9ment de loyer<\/strong>, si pr\u00e9sent.<\/li>\n<\/ul>\n<h2><strong>Le Conseil d&rsquo;Etat rejette l&rsquo;annulation du dispositif<\/strong><\/h2>\n<p>Apr\u00e8s la mise en application de la loi, l\u2019Union nationale des propri\u00e9taires immobiliers (UNPI) et la Chambre nationale des propri\u00e9taires avaient demand\u00e9 plusieurs recours afin de faire annuler le dispositif. La demande, <strong>faite au nom d&rsquo;un exc\u00e8s de pouvoir<\/strong>, portait notamment sur le p\u00e9rim\u00e8tre du territoire de la ville de Paris concern\u00e9 par la mise en place du dispositif d&rsquo;encadrement des loyers. Le 10 mai 2022, <strong>le Conseil d&rsquo;Etat a rejet\u00e9 ce recours<\/strong> ainsi que trois autres requ\u00eates qui portaient sur l\u2019encadrement des loyers dans la ville de Lille ainsi que sur la d\u00e9finition de deux p\u00e9rim\u00e8tres concern\u00e9s en r\u00e9gion parisienne. La haute juridiction administrative n&rsquo;a pas trouv\u00e9 de raison l\u00e9gale de maintenir les recours.<\/p>\n<p>Sur Twitter, <strong>Ian Brossat, adjoint \u00e0 la maire de Paris<\/strong> et charg\u00e9 du <a href=\"https:\/\/avoloi.eu\/logement-insalubre-risques\/\">logement<\/a>, s&rsquo;est f\u00e9licit\u00e9 de cette d\u00e9cision qu&rsquo;il consid\u00e8re comme une <em>\u00ab\u00a0victoire\u00a0\u00bb<\/em> : <em>\u00ab\u00a0Le Conseil d&rsquo;\u00c9tat vient de rejeter le recours de l&rsquo;UNPI visant \u00e0 faire annuler l&rsquo;encadrement des loyers \u00e0 Paris. Une bonne nouvelle pour les locataires qui en ont assez des loyers trop chers\u00a0\u00bb<\/em>, a-t-il pr\u00e9cis\u00e9 sur le r\u00e9seau social.<\/p>\n<h2><strong>Quelle est l&rsquo;efficacit\u00e9 de l&rsquo;encadrement des loyers ?<\/strong><\/h2>\n<p>Malgr\u00e9 le maintien du dispositif, <strong>l&rsquo;encadrement des loyers \u00e0 Paris<\/strong> reste assez peu efficace. Selon une <a href=\"https:\/\/www.lefigaro.fr\/societes\/l-encadrement-des-loyers-reste-peu-efficace-a-paris-20210628\" target=\"_blank\" rel=\"noopener\">enqu\u00eate de Meilleurs Agents publi\u00e9e par Le Figaro<\/a>, deux ans apr\u00e8s l&rsquo;entr\u00e9e en vigueur du dispositif, pr\u00e8s de 50% des annonces ne respectaient toujours pas le montant du loyer de r\u00e9f\u00e9rence. En ce qui concerne les logements meubl\u00e9s, sur lesquels la loi devait avoir le plus d&rsquo;impact, le nombre d&rsquo;annonces ne respectant pas la loi <strong>est de l&rsquo;ordre de 54%<\/strong>. Cette proportion est rest\u00e9e sensiblement la m\u00eame depuis juillet 2019, m\u00eame si certaines am\u00e9liorations ont \u00e9t\u00e9 observ\u00e9es.<\/p>\n<p>Dans la ville de Paris, les <strong>logements vides ont vu leur loyer baisser d&rsquo;environ 2%<\/strong> depuis l&rsquo;entr\u00e9e en vigueur de la loi, <strong>4% pour les logements meubl\u00e9s<\/strong>. Une baisse encore trop peu suffisante pour respecter le cadre des loyers de r\u00e9f\u00e9rence. Ian Brossat, adjoint \u00e0 la maire de Paris, charg\u00e9 du logement, a promis de mettre en place des mesures pour mieux faire respecter l&rsquo;encadrement des loyers dans la capitale.<\/p>\n<h2><strong>Comment savoir si un bien respecte l&rsquo;encadrement des loyers ?<\/strong><\/h2>\n<p>Propri\u00e9taire ou locataire d&rsquo;un bien immobilier, il est facile de savoir si le bien respecte <strong>le dispositif d&rsquo;encadrement des loyers<\/strong>. La pr\u00e9fecture de la r\u00e9gion \u00cele-de-France a <a href=\"http:\/\/www.referenceloyer.drihl.ile-de-france.developpement-durable.gouv.fr\/\" target=\"_blank\" rel=\"noopener\">mis en place un simulateur<\/a> permettant de trouver toutes les informations n\u00e9cessaires. Ce dispositif est pour l&rsquo;instant disponible pour <strong>la ville de Paris<\/strong>, le <strong>territoire de Plaine Commune<\/strong> et <strong>Est Ensemble<\/strong>. Il vous suffit ensuite de renseigner les caract\u00e9ristiques du logement, la p\u00e9riode concern\u00e9e et l&rsquo;adresse pour conna\u00eetre les informations dont vous avez besoin.<\/p>\n<p>Si vous d\u00e9sirez en savoir plus, vous pouvez \u00e9galement consulter <a href=\"https:\/\/www.service-public.fr\/particuliers\/vosdroits\/F13723\" target=\"_blank\" rel=\"noopener\">l&rsquo;indice de r\u00e9f\u00e9rence des loyers<\/a>. Cet outil est r\u00e9vis\u00e9 tous les trimestres et se calque sur l&rsquo;\u00e9volution des prix \u00e0 la consommation (hors tabac et hors loyers). L&rsquo;indice doit \u00e9galement \u00eatre pris en compte lors de la r\u00e9vision annuelle du loyer pr\u00e9vue dans le contrat de bail.
