C\u2019est l\u2019histoire d\u2019une ch\u00f4meuse \u00ab\u00a0professionnelle\u00a0\u00bb\u2026<\/em><\/strong><\/em><\/strong><\/h3>\n\n\n\n

Apr\u00e8s 5 mois de formation professionnelle pour devenir naturopathe, une femme au ch\u00f4mage et inscrite \u00e0 P\u00f4le Emploi stoppe sa formation et r\u00e9silie le contrat pour raisons personnelles, en laissant un solde impay\u00e9\u2026 que lui r\u00e9clame la soci\u00e9t\u00e9 de formation\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

\u00ab\u00a0Trop tard\u00a0\u00bb, observe la ch\u00f4meuse qui rappelle qu\u2019elle est une \u00ab\u00a0consommatrice\u00a0\u00bb et non une \u00ab\u00a0professionnelle\u00a0\u00bb\u00a0: la soci\u00e9t\u00e9 avait donc 2 ans pour lui r\u00e9clamer le solde impay\u00e9. Or, elle a r\u00e9sili\u00e9 son contrat depuis plus longtemps\u2026 \u00ab\u00a0Non\u00a0\u00bb, conteste la soci\u00e9t\u00e9\u00a0: la ch\u00f4meuse a conclu un contrat ayant une finalit\u00e9 professionnelle (devenir naturopathe). Pour elle, cela justifie que la ch\u00f4meuse soit consid\u00e9r\u00e9e comme une \u00ab\u00a0professionnelle\u00a0\u00bb, ce qui rend sa demande de paiement parfaitement valable\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

Pour le juge, la ch\u00f4meuse doit effectivement \u00eatre consid\u00e9r\u00e9e comme une\u2026 \u00ab\u00a0professionnelle\u00a0\u00bb\u00a0! Et en tant que tel, la soci\u00e9t\u00e9 a donc 5 ans pour agir contre elle. Ayant ici agi en temps voulu, la ch\u00f4meuse doit donc lui verser le solde impay\u00e9.<\/p>\n\n\n\n
