{"id":23147,"date":"2022-04-18T16:14:00","date_gmt":"2022-04-18T14:14:00","guid":{"rendered":"https:\/\/avoloi.eu\/?p=23147"},"modified":"2022-04-18T16:14:00","modified_gmt":"2022-04-18T14:14:00","slug":"taux-endettement-assurance","status":"publish","type":"post","link":"https:\/\/avoloi.fr\/blog\/taux-endettement-assurance\/","title":{"rendered":"Taux d\u2019endettement et assurance emprunteur\u00a0: ce qui change en mati\u00e8re de cr\u00e9dit immobilier en 2022"},"content":{"rendered":"<p>Tandis que les recommandations \u00e9mises par le Haut conseil de stabilit\u00e9 financi\u00e8re\u00a0(HCSF) en mati\u00e8re de cr\u00e9dit immobilier deviennent obligatoires, <a href=\"https:\/\/www.legifrance.gouv.fr\/loda\/id\/JORFTEXT000045268729\/\">la loi Lemoine du 28 f\u00e9vrier 2022<\/a> facilite l\u2019acc\u00e8s des particuliers aux contrats d\u2019assurance emprunteur. Quelles sont donc en 2022 les nouvelles conditions d\u2019emprunt pour les porteurs de projets immobiliers\u00a0?<\/p>\n<h2><strong>Les restrictions applicables depuis le 1er janvier 2022<\/strong><\/h2>\n<p>Bien que globalement respect\u00e9es par les organismes de cr\u00e9dit, les recommandations du HCSF en mati\u00e8re d\u2019octroi de pr\u00eat immobilier ont, au 1er\u00a0janvier\u00a02022, pris un caract\u00e8re obligatoire. Les pr\u00eats immobiliers de longues dur\u00e9es, de m\u00eame que les taux d\u2019endettement \u00e9lev\u00e9s, sont d\u00e9sormais \u00e9troitement encadr\u00e9s.<\/p>\n<h3><strong>Un taux d&rsquo;endettement limit\u00e9 \u00e0 35 %<\/strong><\/h3>\n<p>Les \u00e9tablissements financiers ne peuvent plus proposer de cr\u00e9dit immobilier ayant pour cons\u00e9quence de porter le taux d&rsquo;effort de l\u2019emprunteur \u00e0 plus de 35\u00a0% de ses revenus nets. Ce taux d\u2019endettement correspond au rapport entre les revenus du foyer (salaires nets, revenus professionnels non salari\u00e9s, pensions, loyers \u00e0 percevoir&#8230;) et ses charges fixes.<\/p>\n<h3><strong>Une dur\u00e9e maximum d\u2019emprunt de 25 ans<\/strong><\/h3>\n<p>D\u00e9sormais, la dur\u00e9e maximale du cr\u00e9dit immobilier est limit\u00e9e \u00e0 25\u00a0ans. Cette dur\u00e9e peut, cependant, \u00eatre port\u00e9e jusqu\u2019\u00e0 27\u00a0ans lorsque le pr\u00eat inclut un diff\u00e9r\u00e9 d\u2019amortissement, notamment en cas de vente en l\u2019\u00e9tat futur d\u2019ach\u00e8vement (VEFA) ou d\u2019un contrat de construction de maisons individuelles, ou lorsqu\u2019il concerne un projet d\u2019acquisition d\u2019un bien immobilier ancien impliquant des travaux particuliers.<\/p>\n<h3><strong>Comment contourner le taux d\u2019endettement de 35\u00a0%\u00a0maximum ?<\/strong><\/h3>\n<p>Pour augmenter ses chances de passer sous le seuil des 35\u00a0% d\u2019endettement, il est essentiel de bien pr\u00e9parer son dossier en envisageant, par exemple, une augmentation de son apport personnel, un rachat ou un regroupement de ses cr\u00e9dits \u00e0 la consommation ou un allongement de la dur\u00e9e du pr\u00eat immobilier.<\/p>\n<p>Il est \u00e0 noter, toutefois, que les \u00e9tablissements de cr\u00e9dit conservent une certaine <strong>marge de flexibilit\u00e9<\/strong>. Ceux-ci peuvent ainsi soustraire jusqu\u2019\u00e0 20 % des nouveaux cr\u00e9dits immobiliers produits chaque trimestre \u00e0 l\u2019interdiction de d\u00e9passement des 35\u00a0% de taux d\u2019endettement. Ce quota de 20\u00a0% de cr\u00e9dits est n\u00e9anmoins r\u00e9serv\u00e9 par priorit\u00e9 aux acqu\u00e9reurs de leur r\u00e9sidence principale (80% minimum, dont 30\u00a0% au moins de primo-acc\u00e9dants). Les banques demeurent donc libres de consacrer 4% de leur production trimestrielle de cr\u00e9dits aux projets immobiliers et aux candidats \u00e0 l\u2019emprunt de leur choix.<\/p>\n<p>Ces dispositions s&rsquo;appliquent <strong>aux nouvelles offres de contrats de pr\u00eat<\/strong>, \u00e0 l&rsquo;exception des cr\u00e9dits relais ainsi que des ren\u00e9gociations, rachats et regroupements de cr\u00e9dits. \u00c0 savoir en outre que, m\u00eame si les banques \u00e9tudient la solvabilit\u00e9 de chaque associ\u00e9, les emprunts des soci\u00e9t\u00e9s civiles immobili\u00e8res (SCI) ne sont pas directement concern\u00e9s par la limite des 35\u00a0% de taux d\u2019endettement.<\/p>\n<h2><strong>Les assouplissements pr\u00e9vus \u00e0 compter du 1er juin 2022<\/strong><\/h2>\n<p>M\u00eame si elle n\u2019est pas obligatoire, la <strong>souscription d\u2019un contrat d\u2019assurance emprunteur<\/strong> constitue g\u00e9n\u00e9ralement un pr\u00e9alable essentiel \u00e0 l\u2019offre de pr\u00eat immobilier. Les garanties minimales sont ainsi impos\u00e9es par l\u2019\u00e9tablissement de cr\u00e9dit selon le type de pr\u00eat et le statut professionnel de l\u2019emprunteur. Ce dernier conserve toutefois la possibilit\u00e9 de choisir l\u2019organisme assureur. La loi Lemoine \u00e9largit davantage encore l\u2019acc\u00e8s des particuliers aux pr\u00eats immobiliers par l\u2019adoption de trois mesures cl\u00e9s.<\/p>\n<h3><strong>Une r\u00e9siliation simplifi\u00e9e du contrat d\u2019assurance emprunteur<\/strong><\/h3>\n<p>\u00c0 compter du 1er\u00a0juin\u00a02022, les contrats d\u2019assurance emprunteur li\u00e9s aux nouvelles offres de pr\u00eats deviennent <strong>r\u00e9siliables sans frais \u00e0 tout moment<\/strong>. La mesure a pour objectif d\u2019ouvrir cette cat\u00e9gorie d\u2019assurances \u00e0 la concurrence et de permettre ainsi aux particuliers de r\u00e9aliser d\u2019importantes \u00e9conomies.<\/p>\n<p>Concernant les contrats d&rsquo;assurance emprunteur en cours au 1er\u00a0juin\u00a02022, la r\u00e9siliation infra-annuelle leur est \u00e9galement applicable mais \u00e0 compter du 1er\u00a0septembre\u00a02022.<\/p>\n<h3><strong>L\u2019extension du droit \u00e0 l\u2019oubli<\/strong><\/h3>\n<p>Le droit \u00e0 l\u2019oubli, qui existe d\u00e9j\u00e0 pour les anciens malades du cancer, est \u00e9tendu aux personnes gu\u00e9ries de l\u2019h\u00e9patite C. En outre, la loi r\u00e9duit le d\u00e9lai pendant lequel le candidat emprunteur a l\u2019obligation de d\u00e9clarer son ancienne maladie \u00e0 <strong>5 ans apr\u00e8s la fin du protocole th\u00e9rapeutique<\/strong>, au lieu des 10 ans initialement fix\u00e9s.<\/p>\n<h3><strong>La disparition partielle du questionnaire m\u00e9dical<\/strong><\/h3>\n<p>La personne qui souhaite contracter un <a href=\"https:\/\/avoloi.eu\/remboursement-credit-immobilier\/\">cr\u00e9dit immobilier<\/a> est, par principe, invit\u00e9e \u00e0 r\u00e9pondre \u00e0 un questionnaire de <a href=\"https:\/\/avoloi.eu\/la-convention-aeras\/\">sant\u00e9<\/a> pr\u00e9alablement \u00e0 la signature du contrat d&rsquo;assurance. La loi Lemoine supprime, au 1er \u00a0juin\u00a02022, le questionnaire m\u00e9dical pr\u00e9alable \u00e0 l\u2019obtention de pr\u00eats immobiliers, lorsque les deux conditions suivantes sont remplies\u00a0:<\/p>\n<ul>\n<li>les montants cumul\u00e9s des cr\u00e9dits assur\u00e9s sont inf\u00e9rieurs \u00e0 200\u00a0000\u00a0euros par emprunteur, soit 400\u00a0000\u00a0euros dans le cas d\u2019un emprunt effectu\u00e9 en couple\u00a0;<\/li>\n<li>l\u2019emprunteur aura moins de 60 ans lors de l\u2019arriv\u00e9e \u00e0 \u00e9ch\u00e9ance du pr\u00eat.<\/li>\n<\/ul>\n<p>Dans ce cadre, les personnes victimes d\u2019un accident ou malades devraient de fait \u00e9chapper aux surprimes et aux refus d\u2019assurance.
