Toutefois, des conditions strictes entourent la r\u00e9tractation d&rsquo;une promesse de vente et au-del\u00e0 d&rsquo;un certain d\u00e9lai, des p\u00e9nalit\u00e9s vont s&rsquo;appliquer pour l&rsquo;acheteur. En 2022, la Cour de Cassation a l\u00e9g\u00e8rement assoupli certaines conditions.<\/p>\n<h2><strong>Les diff\u00e9rences entre la promesse unilat\u00e9rale et le compromis de vente<\/strong><\/h2>\n<p>Pour conna\u00eetre les obligations d&rsquo;un acheteur et d&rsquo;un vendeur lors d&rsquo;une transaction immobili\u00e8re, il convient de distinguer la promesse unilat\u00e9rale de vente et le compromis de vente, qui sont deux contrats distincts.<br \/>\nDans la promesse unilat\u00e9rale de vente, seul le vendeur s&rsquo;engage \u00e0 vendre son bien aux acheteurs potentiels et ces derniers peuvent se r\u00e9tracter \u00e0 tout moment. Dans un compromis de vente, toutes les parties sont impliqu\u00e9es et ont des obligations envers l&rsquo;autre.<\/p>\n<h3><strong>Obligations pour l&rsquo;acheteur et le vendeur<\/strong><\/h3>\n<p>Dans un compromis de vente, le vendeur et l&rsquo;acheteur s&rsquo;engagent tous deux dans la transaction : le premier promet de vendre son bien \u00e0 l&rsquo;acheteur, qui en retour s&rsquo;engage \u00e0 l&rsquo;acqu\u00e9rir. Une promesse unilat\u00e9rale n&rsquo;engage absolument pas l&rsquo;acqu\u00e9reur, m\u00eame si celui-ci doit verser un acompte de 10% du prix de vente au moment de la signature de l&rsquo;acte.<br \/>\nL&rsquo;implication de l&rsquo;acqu\u00e9reur a une grande importance au niveau juridique. Dans le cas o\u00f9 ce dernier souhaite se retirer de la vente, le vendeur peut engager des poursuites pour demander une transaction immobili\u00e8re forc\u00e9e. Des dommages et int\u00e9r\u00eats d&rsquo;un montant \u00e9quivalent \u00e0 5-10% du bien doivent \u00e9galement \u00eatre vers\u00e9s.<\/p>\n<h2><strong>D\u00e9lai du droit de r\u00e9tractation de compromis de vente<\/strong><\/h2>\n<p>La signature d&rsquo;une promesse de vente n&rsquo;engage pas le futur acqu\u00e9reur imm\u00e9diatement. En effet, ce dernier dispose d&rsquo;un d\u00e9lai l\u00e9gal de r\u00e9tractation d&rsquo;une dur\u00e9e de dix jours ouvrables. Ce d\u00e9lai commence d\u00e8s le lendemain de la remise en main propre du compromis de vente ou le lendemain de la pr\u00e9sentation de la lettre recommand\u00e9e avec avis de r\u00e9ception notifiant la signature du compromis de vente.<\/p>\n<p>Si le dernier jour du d\u00e9lai l\u00e9gal de r\u00e9tractation tombe un samedi, un dimanche, un jour f\u00e9ri\u00e9 ou ch\u00f4m\u00e9, ce d\u00e9lai est rallong\u00e9 d&rsquo;une journ\u00e9e. C&rsquo;est la date d&rsquo;envoi de la demande qui sera prise en compte pour v\u00e9rifier la l\u00e9galit\u00e9 du d\u00e9lai.<\/p>\n<h2><strong>Comment se r\u00e9tracter d&rsquo;un compromis de vente ?<\/strong><\/h2>\n<p>Seul l&rsquo;acqu\u00e9reur peut se r\u00e9tracter d&rsquo;un compromis de vente mais il doit respecter des conditions tr\u00e8s strictes, notamment s&rsquo;il se trouve encore dans le d\u00e9lai l\u00e9gal. Dans le cas d&rsquo;acheteurs mari\u00e9s, les deux signatures doivent se trouver sur la demande, sauf si l&rsquo;un des \u00e9poux est mandat\u00e9 pour repr\u00e9senter le conjoint. Si la vente immobili\u00e8re comporte plusieurs acheteurs, toute r\u00e9tractation se fait \u00e0 titre individuel et n&rsquo;engage que la personne qui en fait la demande.<\/p>\n<h3><strong>Avant l&rsquo;expiration du d\u00e9lai de r\u00e9tractation<\/strong><\/h3>\n<p>Dans le cas o\u00f9 l&rsquo;acheteur se trouve toujours dans le d\u00e9lai l\u00e9gal de r\u00e9tractation de dix jours, il peut envoyer une lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception pour notifier sa demande. Dans une vente entre particuliers, la lettre recommand\u00e9e doit \u00eatre envoy\u00e9e au vendeur. Si un acte authentique a \u00e9t\u00e9 r\u00e9dig\u00e9 par un notaire, l&rsquo;acheteur qui souhaite se r\u00e9tracter doit envoyer sa lettre au cabinet de ce dernier.<\/p>\n<p>Il n&rsquo;est pas obligatoire de mentionner le motif de la r\u00e9tractation et l&rsquo;annulation n&rsquo;entra\u00eene aucune p\u00e9nalit\u00e9 pour l&rsquo;acqu\u00e9reur. Ce dernier se verra \u00e9galement rembourser tout d\u00e9p\u00f4t de garantie pr\u00e9alablement vers\u00e9, dans sa totalit\u00e9. Le <a href=\"https:\/\/avoloi.eu\/logement-insalubre-risques\/\">propri\u00e9taire<\/a> vendeur ne dispose d&rsquo;aucun recours l\u00e9gal pour obliger l&rsquo;autre partie \u00e0 acqu\u00e9rir le bien.<\/p>\n<h3><strong>Un e-mail peut-il suffire pour se retirer d&rsquo;un compromis ?<\/strong><\/h3>\n<p>Jusqu&rsquo;en 2022, il \u00e9tait obligatoire d&rsquo;envoyer une lettre recommand\u00e9e avec accus\u00e9 de r\u00e9ception pour se r\u00e9tracter d&rsquo;un compromis de vente. Mais en f\u00e9vrier 2022, la Cour de Cassation a cass\u00e9 un arr\u00eat de la Cour d&rsquo;Appel dans le cadre d&rsquo;un conflit au sujet d&rsquo;un compromis de vente. Se basant sur <a href=\"https:\/\/www.legifrance.gouv.fr\/codes\/article_lc\/LEGIARTI000037667917\/\">l&rsquo;article L271-1 du Code de la Construction et de l&rsquo;Habitation<\/a>, la Cour de Cassation a \u00e9tabli que l&rsquo;envoi d&rsquo;un mail pour une demande de r\u00e9tractation pr\u00e9sentait des garanties \u00e9quivalentes \u00e0 l&rsquo;envoi d&rsquo;une lettre recommand\u00e9e.<\/p>\n<p>Les autres conditions n&rsquo;ont toutefois pas \u00e9t\u00e9 modifi\u00e9es : le d\u00e9lai de r\u00e9tractation est toujours de dix jours et le destinataire doit pouvoir justifier de la r\u00e9ception du mail. Cette technique est donc plut\u00f4t r\u00e9serv\u00e9e aux signatures d&rsquo;actes authentiques, afin d&rsquo;\u00e9viter tout conflit.<\/p>\n<h3><strong>Apr\u00e8s l&rsquo;expiration du d\u00e9lai de r\u00e9tractation<\/strong><\/h3>\n<p>Apr\u00e8s l&rsquo;expiration du d\u00e9lai de r\u00e9tractation, l&rsquo;acqu\u00e9reur a toujours la possibilit\u00e9 de se retirer de la vente mais il le fait \u00e0 ses risques et p\u00e9rils. En effet, ce d\u00e9lai pass\u00e9, le vendeur est en droit de demander des dommages et int\u00e9r\u00eats et de saisir la justice pour proc\u00e9der \u00e0 une transaction forc\u00e9e.<\/p>\n<p>Un acqu\u00e9reur peut toutefois se retirer de la vente sans aucune p\u00e9nalit\u00e9, si l&rsquo;une des conditions suspensives du contrat est r\u00e9alis\u00e9e.
