Or, l\u2019annonce publi\u00e9e par l\u2019agent immobilier mentionnait une surface de 110 m\u00b2. Estimant qu\u2019il a commis une faute, le couple r\u00e9clame des indemnit\u00e9s\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

\u00ab\u00a0Hors de question\u00a0!\u00a0\u00bb, r\u00e9torque l\u2019agent immobilier\u00a0: la diff\u00e9rence de 55 m\u00b2 s\u2019explique par des travaux d\u2019agrandissement r\u00e9alis\u00e9s par le vendeur, sans autorisation d\u2019urbanisme. Mais la maison a bel et bien une surface de 110 m\u00b2\u00a0: il n\u2019a donc commis aucune faute. \u00ab\u00a0Si\u00a0\u00bb, r\u00e9torque le couple\u00a0: en admettant avoir eu connaissance de l\u2019ill\u00e9galit\u00e9 des travaux d\u2019agrandissement, l\u2019agent immobilier a commis une faute qui l\u2019a priv\u00e9 d\u2019une possibilit\u00e9 de n\u00e9gocier un prix moins \u00e9lev\u00e9, ou de renoncer \u00e0 la vente\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

Ce que confirme le juge\u00a0: en cachant le caract\u00e8re ill\u00e9gal des constructions, l\u2019agent immobilier a effectivement fait preuve d\u2019une n\u00e9gligence fautive et a priv\u00e9 le couple d\u2019une chance d\u2019obtenir une r\u00e9duction du prix de vente.<\/p>\n\n\n\n
