Un avocat se voit reprocher par un client de ne pas avoir fait appel d\u2019une d\u00e9cision de justice prononc\u00e9e en sa d\u00e9faveur, entra\u00eenant de facto sa condamnation d\u00e9finitive. Ce qui \u00e9tonne l\u2019avocat, pour qui c\u2019\u00e9tait \u00e0 son client d\u2019agir\u2026<\/p>\n\n\n\n

L\u2019objet du litige <\/h3>\n\n\n\n

Il explique que le mandat re\u00e7u ne lui permettait pas de faire appel pour le compte de son client. C\u2019est pour cela que le jour du verdict, il l\u2019a re\u00e7u et lui a indiqu\u00e9 quelles \u00e9taient les diff\u00e9rentes possibilit\u00e9s qui s\u2019offraient \u00e0 lui. Et avant la fin du d\u00e9lai durant lequel son client pouvait faire appel, il l\u2019a, en outre, relanc\u00e9 \u00e0 2 reprises pour savoir s\u2019il avait fait le n\u00e9cessaire. \u00ab Mais je pensais que c\u2019\u00e9tait \u00e0 vous d\u2019agir \u00bb, r\u00e9pond le client, pour qui son avocat ne l\u2019a pas correctement inform\u00e9 de la proc\u00e9dure \u00e0 suivre. Une faute professionnelle qui justifie le versement d\u2019une indemnit\u00e9, selon le client\u2026<\/p>\n\n\n\n

Le verdict <\/h3>\n\n\n\n

Mais pas pour le juge : l\u2019avocat, qui a parfaitement inform\u00e9 son client de la marche \u00e0 suivre et n\u2019a commis aucune faute, n\u2019a pas \u00e0 l\u2019indemniser\u2026<\/p>\n\n\n\n
