Pour \u00e9vincer la veuve, la ni\u00e8ce remet en question la validit\u00e9 du mariage\u00a0: celui-ci ne serait qu\u2019un mariage de raison, donc illicite\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> L\u2019objet du litige <\/h3>\n\n\n\n<p>Elle rappelle que les \u00e9poux avaient 30 ans de diff\u00e9rence d\u2019\u00e2ge et que son oncle ne s\u2019est mari\u00e9 que pour avoir une pr\u00e9sence bienveillante \u00e0 ses c\u00f4t\u00e9s, son \u00e9pouse devant s\u2019occuper de lui en \u00e9change d\u2019une protection financi\u00e8re. Pour la  ni\u00e8ce, il n\u2019y a donc jamais eu d\u2019intention matrimoniale\u00a0: le mariage doit donc \u00eatre annul\u00e9. \u00ab\u00a0Certes, c\u2019est un mariage de raison\u00a0\u00bb, conc\u00e8de la veuve, mais il n\u2019en est pas moins l\u00e9gal, son mari et elle ayant toujours eu une communaut\u00e9 de vie, ce qui est l\u00e0 l\u2019essentiel\u2026<\/p>\n\n\n\n<h3 class=\"wp-block-heading\"> Le verdict <\/h3>\n\n\n\n<p>\u00ab\u00a0Exact\u00a0\u00bb, confirme le juge\u00a0: les \u00e9poux ont eu une communaut\u00e9 de vie effective et aucun \u00e9l\u00e9ment ne permet de penser que la veuve n\u2019a pas eu l\u2019intention d\u2019honorer ses engagements maritaux.
